NEW SECTION. 802.2C Accessory after the fact. 1 2 An indictment or information for the offense of accessory 1 3 after the fact in violation of section 703.3 that involves a 1 4 kidnapping in violation of section 710.2, 710.3, or 710.4 shall 1 5 be found within ten years after commission of the offense of 1 6 accessory after the fact. 1 7 Sec. 2. Section 802.3, Code 2016, is amended to read as 1 8 follows: 1 9 802.3 Felony == aggravated or serious misdemeanor. 1 10 In all cases, except those enumerated in section 802.1, 1 11 802.2, 802.2A, 802.2B, 802.2C, or 802.10, an indictment or 1 12 information for a felony or aggravated or serious misdemeanor 1 13 shall be found within three years after its commission. 1 14 EXPLANATION 1 15 The inclusion of this explanation does not constitute agreement with 1 16 the explanation's substance by the members of the general assembly. 1 17 This bill relates to the limitation of action (statute of 1 18 limitations) for the criminal offense of accessory after the 1 19 fact involving kidnapping. 1 20 The bill provides that an indictment or information for 1 21 the offense of accessory after the fact in violation of Code 1 22 section 703.3 that involves a kidnapping in violation of Code 1 23 section 710.2 (kidnapping in the first degree), Code section 1 24 710.3 (kidnapping in the second degree), or Code section 710.4 1 25 (kidnapping in the third degree) shall be found within 10 1 26 years after the commission of the offense of accessory after 1 27 the fact. Current law provides that such violation shall be 1 28 found within three years after the commission of the offense of 1 29 accessory after the fact. 1 30 A person who commits the offense of accessory after the fact 1 31 involving kidnapping in the first degree, second degree, or 1 32 third degree commits an aggravated misdemeanor. 1 33 An aggravated misdemeanor is punishable by confinement for 1 34 no more than two years and a fine of at least $625 but not more 1 35 than $6,250.
