Section 331.502, subsection 1, Code 2018, is 1 2 amended to read as follows: 1 3 1. Have general custody and control of the courthouse, and 1 4 shall have supervisory custody and control of areas of the 1 5 courthouse not occupied by the judicial branch, subject to the 1 6 direction of the board. 1 7 Sec. 2. NEW SECTION. 602.1303A Supervision and control. 1 8 1. For purposes of this section "occupied" means 1 9 courtrooms, offices, and other physical facilities used 1 10 exclusively by officers and employees of the judicial branch. 1 11 2. The judicial branch shall have supervisory custody and 1 12 control of only the areas occupied by the judicial branch in 1 13 facilities provided by a county or city pursuant to section 1 14 602.1303. 1 15 3. The county or city shall have supervisory custody and 1 16 control of all other areas in facilities not occupied by the 1 17 judicial branch. 1 18 EXPLANATION 1 19 The inclusion of this explanation does not constitute agreement with 1 20 the explanation's substance by the members of the general assembly. 1 21 This bill relates to the supervisory custody and control of a 1 22 county courthouse. 1 23 Currently, the county auditor has general custody and 1 24 control of the courthouse, subject to the direction of the 1 25 board of supervisors. The bill specifies that the county 1 26 auditor shall have supervisory custody and control of areas of 1 27 the courthouse not occupied by the judicial branch, subject to 1 28 the direction of the board of supervisors. 1 29 The bill creates new Code section 602.1303A specifying that 1 30 the judicial branch shall have supervisory custody and control 1 31 of only the areas occupied by the judicial branch in facilities 1 32 provided by a county or city pursuant to Code section 602.1303. 1 33 The county or city shall have supervisory custody and control 1 34 of all other areas in facilities not occupied by the judicial 1 35 branch. 2 1 The bill defines "occupied" to mean courtrooms, offices, 2 2 and other physical facilities used exclusively by officers and 2 3 employees of the judicial branch.
