Section 135.63, subsection 4, paragraph a, Code 1 2 2015, is amended to read as follows: 1 3 a. The new or changed beds shall not result in an 1 4 increase in the total number of medical assistance certified 1 5 intermediate care facility beds for persons with an 1 6 intellectual disability in the state,exclusive ofincluding 1 7 those beds at the state resource centers or other state 1 8 institutions, beyond one thousand six hundred thirty=six beds. 1 9 Sec. 2. Section 249A.12, Code 2015, is amended by adding the 1 10 following new subsection: 1 11 NEW SUBSECTION. 8. Beginning July 1, 2015, the limitation 1 12 on the number of medical assistance certified intermediate care 1 13 facility beds for persons with an intellectual disability of 1 14 one thousand six hundred thirty=six beds specified in section 1 15 135.63, subsection 4, shall be permanently reduced to reflect 1 16 any reduction in such beds at the state resource centers due 1 17 to outplacement and census decline. Any assistance furnished 1 18 under this chapter to a state resource center attributable 1 19 to an individual representing such an outplacement or census 1 20 decline, less an amount which represents the portion of 1 21 such assistance provided to such individual that reflects 1 22 the state resource center's fixed costs and infrastructure, 1 23 shall continue to be provided to the individual to the extent 1 24 necessary to instead provide a subsequent placement in a 1 25 community=based setting. The resource center shall continue to 1 26 downsize and restructure the resource center's infrastructure 1 27 to reflect any permanent decline in beds under this subsection 1 28 to meet the needs and number of individuals actually served. 1 29 EXPLANATION 1 30 The inclusion of this explanation does not constitute agreement with 1 31 the explanation's substance by the members of the general assembly. 1 32 This bill relates to the number of medical assistance 1 33 certified intermediate care facility beds for persons with an 1 34 intellectual disability (ICF/ID) in the state. The bill amends 1 35 the certificate of need provisions relating to ICF/ID beds to 2 1 provide that the limitation on the number of such beds of 1,636 2 2 includes such beds at the state resource centers and other 2 3 state institutions. The bill requires that beginning July 1, 2 4 2015, the limitation of 1,636 beds shall be permanently reduced 2 5 to reflect any reduction in such beds at the state resource 2 6 centers due to outplacement and census decline. Any medical 2 7 assistance furnished to a state resource center attributable to 2 8 an individual representing the outplacement or census decline, 2 9 less an amount for the portion of the medical assistance 2 10 provided to that individual that reflects the state resource 2 11 center's fixed costs and infrastructure, shall continue to 2 12 be provided to the individual to the extent necessary to 2 13 instead provide a subsequent placement in a community=based 2 14 setting. The bill directs the resource centers to continue to 2 15 downsize and restructure their infrastructure to reflect any 2 16 such permanent decline in beds to meet the needs and number of 2 17 individuals actually served.
