1.
Section
260C.14,
Code
2011,
is
amended
by
adding
1
the
following
new
subsection:

NEW
SUBSECTION

23.
Adopt
a
policy,
to
take
effect

not
later
than
January
1,
2013,
relating
to
an
additional
4
classification
of
students
for
purposes
of
determining
tuition
5
and
fees,
that
provides
equal
opportunity
for
granting
resident
6
status
to
individuals
who
meet
all
of
the
following
conditions:

a.
Attended
an
accredited
school
in
this
state
for
at
least
8
five
years
as
of
the
date
the
individual
graduated
from
an
9
accredited
high
school
or
received
a
high
school
equivalency
10
diploma
in
this
state.
11
b.
Is
accepted
for
enrollment
by
the
community
college.
12
c.
Was
not
required
to
pay
tuition
to
attend
a
public
high
13
school
in
this
state.
14
d.
Signs
an
affidavit,
if
the
individual
does
not
have
a
15
social
security
number,
stating
that
the
individual
will
pursue
16
citizenship
in
the
United
States
at
the
earliest
possible
time
17
the
individual
is
able
to
do
so.

amended
by

adding
the

EXPLANATION

This
bill
directs
the
board
of
directors
of
a
community
4
college
and
the
state
board
of
regents
to
adopt
policies,
5
to
take
effect
not
later
than
January
1,
2013,
relating
to
6
an
additional
classification
of
students
for
purposes
of
7
determining
tuition
and
fees,
that
provide
equal
opportunity
8
for
granting
resident
status
to
certain
individuals.
9
To
meet
the
requirements
of
the
policy,
an
individual
10
must
have
attended
an
accredited
school
in
this
state
for
11
at
least
five
years
or
received
a
high
school
equivalency
12
diploma
in
this
state,
be
accepted
for
enrollment
by
a
public
13
postsecondary
institution
in
this
state,
must
not
have
been
14
required
to
pay
tuition
to
attend
a
public
high
school
in
this
15
state,
and
must
sign
an
affidavit,
if
the
individual
does
not
16
have
a
social
security
number,
stating
that
the
individual
17
will
pursue
U.S.
citizenship
at
the
earliest
possible
time
the
18
individual
is
able
to
do
so.
