  3 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:

  1  1    Section 1.  Section 481A.48, Code 2016, is amended by adding
  1  2 the following new subsection:
  1  3    NEW SUBSECTION.  6.  A person who legally possesses a handgun
  1  4 may carry that handgun while hunting during any hunting season
  1  5 so long as the person is otherwise legally qualified to carry
  1  6 the handgun.  However, a person shall not use a handgun to hunt
  1  7 unless the person has a valid hunting license with an unfilled
  1  8 tag that permits use of that handgun to hunt during the season
  1  9 in which the handgun is being used.
  1 10    Sec. 2.  Section 805.8B, subsection 3, paragraph h,
  1 11 subparagraph (5), Code 2016, is amended to read as follows:
  1 12    (5)  Possession Prohibited use of a prohibited handgun,
  1 13  pistol, or revolver while hunting deer, the scheduled fine is
  1 14 one hundred dollars.
  1 15                           EXPLANATION
  1 16 The inclusion of this explanation does not constitute agreement with
  1 17 the explanation's substance by the members of the general assembly.
  1 18    This bill allows a hunter to carry a handgun while hunting.
  1 19    The bill adds new Code section 481A.48(6) which provides
  1 20 that a person who legally possesses a handgun may carry that
  1 21 handgun while hunting during any hunting season so long as
  1 22 the person is otherwise legally qualified to carry a handgun.
  1 23 However, a person shall not use a handgun to hunt unless the
  1 24 person has a valid hunting license with an unfilled tag that
  1 25 permits the use of that handgun to hunt during the season in
  1 26 which the handgun is being used.  A violation of the bill's
  1 27 provisions is punishable with a scheduled fine of $100.
