  1  1    Section 1.  Section 321.438, subsection 2, Code 2016, is
  1  2 amended to read as follows:
  1  3    2.  A person shall not operate on the highway a motor
  1  4 vehicle equipped with a front windshield, a side window to
  1  5 the immediate right or left of the driver, or a side=wing
  1  6 forward of and to the left or right of the driver which is
  1  7 excessively dark or reflective so that it is difficult for a
  1  8 person outside the motor vehicle to see into the motor vehicle
  1  9 through the windshield, window, or sidewing. The department
  1 10 shall adopt rules establishing a minimum measurable standard
  1 11 of transparency which shall apply to violations of this
  1 12 subsection.  This subsection shall not apply if the person
  1 13 possesses in the motor vehicle a signed document from the
  1 14 person's physician licensed under chapter 148 or optometrist
  1 15 licensed under chapter 154, written on the physician's or
  1 16 optometrist's stationary, stating that the dark or reflective
  1 17 windshield, window, or sidewing is necessary for the person's
  1 18 health.
  1 19                           EXPLANATION
  1 20 The inclusion of this explanation does not constitute agreement with
  1 21 the explanation's substance by the members of the general assembly.
  1 22    Under current law, a person is prohibited from operating a
  1 23 motor vehicle equipped with an excessively dark or reflective
  1 24 windshield, window, or sidewing. A violation of this
  1 25 prohibition is punishable by a scheduled fine of $50. This
  1 26 bill provides that the prohibition against operating a motor
  1 27 vehicle with an excessively dark or reflective windshield,
  1 28 window, or sidewing does not apply if the person possesses in
  1 29 the motor vehicle a signed document from the person's physician
  1 30 or optometrist, written on the physician's or optometrist's
  1 31 stationary, stating that the dark or reflective windshield,
  1 32 window, or sidewing is necessary for the person's health.
