H.F. 2206 Section 1. Section 707.8, subsection 3, Code 2022, is 1 amended to read as follows: 2 3. a. A person who intentionally terminates a human 3 pregnancy without the knowledge and voluntary consent of the 4 pregnant person is guilty of a class “C” felony. 5 b. A person who attempts to intentionally terminate a human 6 pregnancy without the knowledge and voluntary consent of the 7 pregnant person is guilty of a class “D” felony. 8 EXPLANATION 9 The inclusion of this explanation does not constitute agreement with 10 the explanation’s substance by the members of the general assembly. 11 This bill relates to the nonconsensual termination of a 12 human pregnancy. 13 Current law provides that a person who intentionally 14 terminates a human pregnancy without the knowledge and 15 voluntary consent of the pregnant person is guilty of a class 16 “C” felony. A class “C” felony is punishable by confinement 17 for no more than 10 years and a fine of at least $1,370 but not 18 more than $13,660. 19 The bill provides that a person who attempts to 20 intentionally terminate a human pregnancy without the knowledge 21 and voluntary consent of the pregnant person is guilty of 22 a class “D” felony. A class “D” felony is punishable by 23 confinement for no more than five years and a fine of at least 24 $1,025 but not more than $10,245. 25 -1- LSB 5672YH (7) 89 pf/rh 1/ 1
