  1  1    Section 1.  Section 331.391, subsection 4, paragraph b, Code
  1  2 2018, is amended to read as follows:
  1  3    b.  For fiscal years beginning July 1, 2017, July 1, 2018,
  1  4 and July 1, 2019, that portion of each region's cash flow
  1  5 amount either reserved in the combined account or reserved
  1  6 among all separate county accounts under the control of the
  1  7 governing board that exceeds twenty=five percent of the gross
  1  8 expenditures from the combined account or from all separate
  1  9 county accounts under control of the governing board in the
  1 10 fiscal year preceding the fiscal year in progress shall be used
  1 11 in whole or in part to fund the payment of services provided
  1 12 under the regional service system management plan under section
  1 13 331.393, which may include expenses associated with increasing
  1 14 capacity to provide services to persons with substance=related
  1 15 disorders and persons with co=occurring mental health and
  1 16 substance=related disorders.
  1 17    Sec. 2.  Section 331.393, subsection 2, Code 2018, is amended
  1 18 to read as follows:
  1 19    2.  Each region shall submit to the department an annual
  1 20 service and budget plan approved by the region's governing
  1 21 board and subject to approval by the director of human
  1 22 services. Provisions for the director of human services'
  1 23 approval of the annual service and budget plan, and any
  1 24 amendments to the plan, and other requirements shall be
  1 25 specified in rule adopted by the state commission.
  1 26    a.  The provisions addressed in the annual plan shall include
  1 27 but are not limited to all of the following:
  1 28    a.  (1)  The region's budget and financing provisions for
  1 29 the next fiscal year. The provisions shall address how county,
  1 30 regional, state, and other funding sources will be used to meet
  1 31 the service needs within the region.
  1 32    b.  (2)  The scope of services included in addition to
  1 33 the required core services. Each service included shall be
  1 34 described and projection of need and the funding necessary to
  1 35 meet the need shall be included.
  2  1    c.  (3)  The location of the local access points for
  2  2 services.
  2  3    d.  (4)  The plan for assuring effective crisis prevention,
  2  4 response, and resolution.
  2  5    e.  (5)  The provider reimbursement provisions. A region's
  2  6 use of provider reimbursement approaches in addition to
  2  7 fee=for=service reimbursement and for compensating the
  2  8 providers engaged in a systems of care approach and other
  2  9 nontraditional providers shall be encouraged. A region also
  2 10 shall be encouraged to use and the department shall approve
  2 11 funding approaches that identify and incorporate all services
  2 12 and sources of funding used by persons receiving services,
  2 13 including medical assistance program funding.
  2 14    f.  (6)  Financial forecasting measures.
  2 15    g.  (7)  The targeted case managers designated for the
  2 16 region.
  2 17    h.  (8)  The financial eligibility requirements for service
  2 18 under the regional service system. A plan that otherwise
  2 19 incorporates the financial eligibility requirements of section
  2 20 331.395 but allows eligibility for persons with resources above
  2 21 the minimum resource limitations adopted pursuant to section
  2 22 331.395, subsection 1, paragraph "c", who were eligible under
  2 23 resource limitations in effect prior to July 1, 2014, or are
  2 24 authorized by the region as an exception to policy, shall be
  2 25 deemed by the department to be in compliance with financial
  2 26 eligibility requirements of section 331.395.
  2 27    b.  The provisions addressed in the annual plan may include
  2 28 a plan for the use of anticipated residual funding in excess
  2 29 of twenty=five percent of the gross expenditures as provided
  2 30 in section 331.391, subsection 4, paragraph "b", to increase
  2 31 capacity to provide services to persons with substance=related
  2 32 disorders and co=occurring mental health and substance=related
  2 33 disorders.
  2 34    Sec. 3.  Section 331.397, Code 2018, is amended by adding the
  2 35 following new subsection:
  3  1    NEW SUBSECTION.  6A.  Notwithstanding any other provision
  3  2 of this section to the contrary, a regional service system
  3  3 may provide funding to increase capacity to provide services
  3  4 to persons with substance=related disorders and persons with
  3  5 co=occurring mental health and substance=related disorders
  3  6 pursuant to section 331.391, subsection 4, paragraph "b".
  3  7    Sec. 4.  EFFECTIVE DATE.  This Act, being deemed of immediate
  3  8 importance, takes effect upon enactment.
  3  9                           EXPLANATION
  3 10 The inclusion of this explanation does not constitute agreement with
  3 11 the explanation's substance by the members of the general assembly.
  3 12    Under current law, if a mental health and disability
  3 13 services region is meeting the financial obligations for
  3 14 implementation of its regional service system management plan
  3 15 for a fiscal year and residual funding is anticipated, the
  3 16 regional administrator shall reserve an adequate amount of
  3 17 unobligated and unencumbered funds for cash flow of expenditure
  3 18 obligations in the next fiscal year.  For fiscal years
  3 19 beginning July 1, 2017, July 1, 2018, and July 1, 2019,  that
  3 20 portion of each region's cash flow amount either reserved in
  3 21 the combined account or reserved among all separate county
  3 22 accounts under the control of the governing board that exceeds
  3 23 25 percent of the gross expenditures from the combined account
  3 24 or from all separate county accounts under the control of the
  3 25 governing board in the fiscal year preceding the fiscal year in
  3 26 progress are required to be used in whole or in part to fund the
  3 27 payment of services provided under the regional service system
  3 28 management plan.  The bill provides such funds may be used
  3 29 for expenses associated with increasing capacity to provide
  3 30 services to persons with substance=related disorders and
  3 31 persons with co=occurring mental health and substance=related
  3 32 disorders.
  3 33    Current law requires each region to submit to the department
  3 34 of human services an annual service and budget plan approved
  3 35 by the region's governing board and subject to the approval of
  4  1 the director of human services.  The bill provides the annual
  4  2 service and budget plan may include a plan for the use of
  4  3 anticipated residual funding in excess of 25 percent of the
  4  4 gross expenditures to increase capacity to provide services
  4  5 to persons with substance=related disorders and co=occurring
  4  6 mental health and substance=related disorders, and that a
  4  7 regional service system may provide funding for such services.
  4  8    The bill takes effect upon enactment.
