  3 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:

  1  1    Section 1.  Section 256.7, subsection 32, paragraph c,
  1  2 unnumbered paragraph 1, Code 2016, is amended to read as
  1  3 follows:
  1  4    Adopt rules that limit the statewide enrollment of
  1  5 pupils in educational instruction and course content that
  1  6 are delivered primarily over the internet to not more than
  1  7 eighteen one=hundredths of one percent of the statewide
  1  8 enrollment of all pupils, and that limit the number of pupils
  1  9 participating in open enrollment for purposes of receiving
  1 10 educational instruction and course content that are delivered
  1 11 primarily over the internet to no more than one percent of
  1 12 a sending district's enrollment. Until June 30, 2018, such
  1 13  Such limitations shall not apply if the limitations would
  1 14 prevent siblings from enrolling in the same school district or
  1 15 if a sending district determines that the educational needs
  1 16 of a physically or emotionally fragile student would be best
  1 17 served by educational instruction and course content that are
  1 18 delivered primarily over the internet. Students who meet
  1 19 the requirements of section 282.18 may participate in open
  1 20 enrollment under this paragraph "c" for purposes of enrolling
  1 21 only in the CAM community school district or the Clayton Ridge
  1 22 community school district.
  1 23    Sec. 2.  Section 256.7, subsection 32, paragraph c, Code
  1 24 2016, is amended by adding the following new subparagraph:
  1 25    NEW SUBPARAGRAPH.  (6)  This paragraph "c" is repealed June
  1 26 30, 2018.
  1 27                           EXPLANATION
  1 28 The inclusion of this explanation does not constitute agreement with
  1 29 the explanation's substance by the members of the general assembly.
  1 30    Current law requires the state board of education to adopt
  1 31 rules for online learning, including rules prohibiting the
  1 32 open enrollment of students whose educational instruction and
  1 33 course content are delivered primarily over the internet. An
  1 34 exception to that prohibition requires the board to adopt rules
  1 35 allowing such enrollment, with limitations on how many students
  2  1 may be enrolled statewide and per school district. Until June
  2  2 30, 2018, such limitations do not apply to certain students.
  2  3 The exception also limits such open enrollment to the CAM
  2  4 community school district or the Clayton Ridge community school
  2  5 district.
  2  6    This bill repeals the exception to the prohibition on June
  2  7 30, 2018. At that time, open enrollment of students whose
  2  8 educational instruction and course content are delivered
  2  9 primarily over the internet would be entirely prohibited.
  2 10    The bill also strikes language providing that until June
  2 11 30, 2018, limitations on how many students may be enrolled
  2 12 statewide and per school district are not applicable to
  2 13 certain students. The bill removes the date limitation of this
  2 14 provision.
