Section
1.
Section
155A.46,
subsection
1,
Code
2024,
is
1
amended
by
adding
the
following
new
paragraph:

NEW
PARAGRAPH
.
f.
(1)
A
pharmacist
may,
pursuant
to
3
statewide
protocols
developed
by
the
board
in
consultation
with
4
the
department
of
health
and
human
services
and
consistent
with
5
subsection
2,
do
all
of
the
following:
6
(a)
Order
and
administer
point-of-care
HIV-related
tests.
7
(b)
Order
and
administer
or
dispense
HIV
pre-exposure
8
prophylaxis
or
HIV
post-exposure
prophylaxis.
9
(2)
Notwithstanding
any
provision
of
a
health
benefit
plan
10
to
the
contrary,
if
a
health
benefit
plan
provides
for
payment
11
or
reimbursement
for
a
service
that
is
within
the
lawful
scope
12
of
practice
of
a
practitioner
or
a
pharmacist,
and
a
service
13
is
provided
by
a
pharmacist
pursuant
to
a
statewide
protocol
14
under
this
paragraph
“f”
,
the
health
carrier
that
issued
the
15
health
benefit
plan
shall
provide
payment
or
reimbursement
for
16
the
service.

(3)
For
the
purposes
of
this
paragraph
“f”
:

(a)
“Health
benefit
plan”
means
the
same
as
defined
in
19
section
514J.102.

(b)
“Health
carrier”
means
the
same
as
defined
in
section
21
514J.102.

(c)
“HIV”
means
the
same
as
defined
in
section
141A.1.
23
(d)
“HIV-related
test”
means
the
same
as
defined
in
section
24
141A.1.

The
inclusion
of
this
explanation
does
not
constitute
agreement
with

the
explanation’s
substance

the
members
of
the
general

This
bill
relates
to
the
ordering,
administering,
and
29
dispensing
of
point-of-care
HIV-related
tests
and
prophylaxis
30
drugs
by
a
pharmacist.
31
The
bill
provides
that
in
accordance
with
statewide
32
protocols
developed
by
the
board
of
pharmacy
(board)
in
33
consultation
with
the
department
of
health
and
human
services,
34
a
pharmacist
may
order
and
administer
a
point-of-care

post-exposure
prophylaxis.

A
pharmacist
offering
services
under
the
bill
shall:
3
maintain
a
record
of
all
point-of-care
HIV-related
tests
and
4
HIV
pre-exposure
prophylaxis
or
HIV
post-exposure
prophylaxis
5
administered;
notify
the
patient’s
primary
health
care
provider
6
of
tests
or
prophylaxis
administered
or
enter
such
information
7
in
a
patient
record
system
also
used
by
the
primary
health
care
8
provider,
as
permitted
by
the
primary
health
care
provider;
9
if
the
patient
does
not
have
a
primary
health
care
provider,
10
provide
the
patient
with
a
written
record
of
the
tests
or
11
prophylaxis
provided,
and
advise
the
patient
to
consult
a
12
physician;
and
complete
continuing
pharmacy
education
related
13
to
the
statewide
protocols.

The
bill
also
requires
that
if
a
health
benefit
plan
provides
15
for
payment
or
reimbursement
for
a
service
that
is
within
the
16
lawful
scope
of
practice
of
a
practitioner
or
a
pharmacist,
and
17
a
service
is
provided
by
a
pharmacist
pursuant
to
a
statewide
18
protocol
under
the
bill,
the
health
carrier
shall
provide
19
payment
or
reimbursement
for
the
service.

The
bill
provides
definitions
of
terms
used
in
the
bill
21
including
“health
benefit
plan”,
“health
carrier”,
“HIV”,
and
22
“HIV-related
test”.
