  1 An Act requiring that vehicles not capable of traveling
  2    thirty=five miles per hour be driven on the shoulder of the
  3    roadway, and providing a penalty.
  4 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:

  1  1    Section 1.  NEW SECTION.  321.296  Slow vehicles required to
  1  2 travel on shoulder.
  1  3    1.  Notwithstanding section 321.297 or any other provision
  1  4 to the contrary, a motor vehicle that is not capable of
  1  5 traveling at a speed of thirty=five miles per hour or more
  1  6 shall be driven on the shoulder to the right of the roadway if
  1  7 the speed limit for the roadway is thirty=five miles per hour
  1  8 or more, the roadway has a shoulder capable of accommodating
  1  9 the motor vehicle, and the shoulder is not blocked by another
  1 10 vehicle or object. However, a motor vehicle subject to this
  1 11 section may be driven on the roadway pursuant to section
  1 12 321.323A.  A person driving a motor vehicle pursuant to this
  1 13 section shall display the vehicle's emergency signal lamps
  1 14 flashing simultaneously. A peace officer may enforce this
  1 15 section by directions to drivers, and in the event of apparent
  1 16 willful disobedience to this section and refusal to comply with
  1 17 the directions of an officer in accordance with this section,
  1 18 a person is guilty of a simple misdemeanor punishable as a
  1 19 scheduled violation under section 805.8A, subsection 6.
  1 20    2.  This section applies to the operation of bicycles, except
  1 21 that a bicycle is not required to display emergency signal
  1 22 lamps unless otherwise provided by law.
  1 23    3.  This section does not apply to the operation of farm
  1 24 tractors or implements of husbandry.
  1 25    Sec. 2.  Section 321.423, subsection 2, Code 2016, is amended
  1 26 by adding the following new paragraph:
  1 27    NEW PARAGRAPH.  k.  On a motor vehicle being operated
  1 28 pursuant to section 321.296.
  1 29    Sec. 3.  Section 805.8A, subsection 6, Code 2016, is amended
  1 30 by adding the following new paragraph:
  1 31    NEW PARAGRAPH.  0e.  Section 321.296$100.
  1 32                           EXPLANATION
  1 33 The inclusion of this explanation does not constitute agreement with
  1 34 the explanation's substance by the members of the general assembly.
  1 35    This bill requires motor vehicles not capable of traveling
  2  1 35 miles per hour to be driven on the shoulder to the right
  2  2 of the roadway if the speed limit for the roadway is 35
  2  3 miles per hour or more, the roadway has a shoulder capable
  2  4 of accommodating the motor vehicle, and the shoulder is not
  2  5 blocked by a vehicle or object. However, the bill provides
  2  6 that a motor vehicle may be driven on the roadway to pass
  2  7 stationary emergency or towing vehicles pursuant to Code
  2  8 section 321.323A.  A person driving a motor vehicle pursuant to
  2  9 the bill is required to display the motor vehicle's emergency
  2 10 signal lamps.
  2 11    The bill authorizes peace officers to enforce the bill
  2 12 by directions to drivers. If a person willfully disobeys
  2 13 an officer, the person is guilty of a simple misdemeanor
  2 14 punishable by a scheduled fine of $100.
  2 15    The bill applies to the operation of bicycles, but not to the
  2 16 operation of farm tractors or implements of husbandry.
