H.F. 2338 Section 1. NEW SECTION . 103A.8D Parking lot construction 1 —— water drainage. 2 A person shall not construct a new parking lot associated 3 with a commercial building unless permeable paving or a 4 reservoir retention system is used in such construction. For 5 purposes of this section, “commercial building” is limited to a 6 commercial building that is intended to be open for business 7 seven days a week for twenty-four hours a day. This section 8 does not apply to the construction of a multiple story parking 9 ramp, a parking lot with a capacity of less than one hundred 10 fifty parking spaces, or a parking lot built by the state, a 11 political subdivision of the state, or a school district. 12 EXPLANATION 13 The inclusion of this explanation does not constitute agreement with 14 the explanation’s substance by the members of the general assembly. 15 This bill relates to the use of permeable paving and 16 reservoir retention systems in the construction of certain 17 parking lots. 18 The bill requires permeable paving or a reservoir retention 19 system to be used in the construction of a new parking lot 20 associated with a commercial building. The bill only applies 21 to a commercial building that is intended to be open for 22 business seven days a week for 24 hours a day. The bill does 23 not apply to the construction of a multiple story parking ramp, 24 a parking lot with a capacity of less than 150 parking spaces, 25 or a parking lot built by the state, a political subdivision of 26 the state, or a school district. 27 -1- LSB 5072YH (8) 85 tm/nh 1/ 1
