H.F. 2352 Section 1. Section 262.9, subsection 22, Code 2024, is 1 amended to read as follows: 2 22. a. Develop a policy and adopt rules relating to the 3 establishment of tuition rates which provide a predictable 4 basis for assessing and anticipating changes in tuition rates. 5 b. (1) The rules shall provide that the amount of tuition 6 and mandatory fees charged by an institution of higher 7 education under the board’s control to a resident undergraduate 8 student admitted on or after July 1, 2024, and on or before 9 July 1, 2028, shall not increase during the student’s first 10 four full academic years of participation in the undergraduate 11 program. 12 (2) Commencing on or before February 1, 2025, and annually 13 on or before each February 1 thereafter, a supplemental 14 appropriation necessary to pay to the institutions of higher 15 education under the board’s control amounts equal to the 16 reduction in tuition and mandatory fees that result from the 17 prohibition in subparagraph (1) shall be established by statute 18 which shall be enacted during the regular legislative session. 19 (3) This paragraph is repealed July 1, 2032. 20 EXPLANATION 21 The inclusion of this explanation does not constitute agreement with 22 the explanation’s substance by the members of the general assembly. 23 This bill relates to the amount of tuition and mandatory fees 24 charged by institutions of higher education governed by the 25 state board of regents. 26 Current law requires the state board of regents to adopt 27 rules related to the establishment of tuition rates which 28 provide a predictable basis for assessing and anticipating 29 changes in tuition rates. The bill requires these rules 30 to provide that the amount of tuition and mandatory fees 31 charged by an institution of higher education to a resident 32 undergraduate student admitted on or after July 1, 2024, and 33 on or before July 1, 2028, shall not increase during the 34 student’s first four full academic years of participation in 35 -1- LSB 6014HT (7) 90 jda/jh 1/ 2

The bill provides that, commencing 1 on or before February 1, 2025, and annually on or before each 2 February 1 thereafter, a supplemental appropriation necessary 3 to pay to the institutions of higher education amounts equal to 4 the reduction in tuition and mandatory fees that result from 5 the freeze on tuition and mandatory fees shall be established 6 by statute.
