Section 232.68, subsection 2, paragraph a, 1 2 subparagraph (3), Code 2018, is amended to read as follows: 1 3 (3) The commission of a sexual offense with or to a child 1 4 pursuant to chapter 709, section 726.2, or section 728.12, 1 5 subsection 1, as a result of the acts or omissions of the 1 6 person responsible for the care of the child or of a person who 1 7 is fourteen years of age or older and resides in a home with 1 8 the child. Notwithstanding section 702.5, the commission of 1 9 a sexual offense under this subparagraph includes any sexual 1 10 offense referred to in this subparagraph with or to a person 1 11 under the age of eighteen years. 1 12 EXPLANATION 1 13 The inclusion of this explanation does not constitute agreement with 1 14 the explanation's substance by the members of the general assembly. 1 15 This bill amends the definition of child abuse in Code 1 16 chapter 232, relating to child abuse reporting and assessments. 1 17 Under current law, child abuse is defined to include the 1 18 commission of a sexual offense with or to a child as a result of 1 19 the acts or omissions of the person responsible for the care of 1 20 the child or of a person, regardless of the age of the person, 1 21 who resides in a home with the child. 1 22 The bill changes current law to provide that child abuse 1 23 includes the commission of a sexual offense with or to a child 1 24 as a result of the acts or omissions of the person responsible 1 25 for the care of the child or of a person who is 14 years of age 1 26 or older and resides in a home with the child.
