ADMINISTRATIVE RULES ==== CHILD SUPPORT 1 2 DELINQUENCY ==== HARDSHIP. The department of human services 1 3 shall revise rules pursuant to chapter 17A to establish the 1 4 criteria and procedures for reviewing the amount to be withheld 1 5 from the obligor's income to pay a child support delinquency 1 6 when such amount is based on the department's hardship 1 7 criteria. The rules shall provide that the child support 1 8 recovery unit may periodically initiate such reviews and that a 1 9 child support obligee may request such a review not more often 1 10 than every two years. The rules shall be effective no later 1 11 than January 1, 2019. 1 12 Sec. 2. EFFECTIVE DATE. This Act, being deemed of immediate 1 13 importance, takes effect upon enactment. 1 14 EXPLANATION 1 15 The inclusion of this explanation does not constitute agreement with 1 16 the explanation's substance by the members of the general assembly. 1 17 This bill requires the department of human services to 1 18 revise rules pursuant to Code chapter 17A to be effective no 1 19 later than January 1, 2019, to establish the criteria and 1 20 procedures for reviewing the amount to be withheld from the 1 21 obligor's income to pay a child support delinquency when such 1 22 amount is based on the department's hardship criteria. The 1 23 rules shall provide that the child support recovery unit may 1 24 periodically initiate such a review and that an obligee may 1 25 also request such a review not more often than every two years.
