Section
1.
NEW
SECTION
.
562B.33
Enforcement.
1
The
attorney
general
shall
have
the
authority
to
investigate
2
and
enforce
repeated
or
multiple
violations
of
this
chapter.
3
Repeated
or
multiple
violations
of
this
chapter
are
an
4
unlawful
practice
under
section
714.16
and
all
the
remedies
and
5
penalties
of
section
714.16
are
available
for
such
a
violation.

EXPLANATION
7
The
inclusion
of
this
explanation
does
not
constitute
agreement
with
8
the
explanation’s
substance
by
the
members
of
the
general
assembly.

This
bill
authorizes
the
attorney
general
to
investigate
and
10
enforce
repeated
or
multiple
violations
of
Code
chapter
562B.
11
The
bill
also
provides
that
repeated
or
multiple
violations
12
of
Code
chapter
562B
are
an
unlawful
practice
under
Code
13
section
714.16
(consumer
frauds).
Several
types
of
remedies
14
are
available
if
a
court
finds
that
a
person
has
committed
an
15
unlawful
practice,
including
injunctive
relief,
disgorgement
of
16
moneys
or
property,
and
a
civil
penalty
not
to
exceed
$40,000

per
violation.
