H.F. 2438 Section 1. NEW SECTION . 256.20 School security —— grant 1 program. 2 1. The department shall establish a school security grant 3 program to provide grants to school districts to help school 4 districts offset the cost associated with installing school 5 safety and security infrastructure, including any of the 6 following: 7 a. Security camera systems. 8 b. Metal detectors. 9 c. Security doors and security windows that can withstand 10 breaching, bullets, and explosive blasts. 11 2. The department shall adopt rules pursuant to chapter 17A 12 to administer this section, including rules relating to grant 13 application materials, eligibility requirements, and award 14 criteria. 15 3. Moneys awarded under this section shall be used to 16 supplement, not supplant, existing public funding used by a 17 school district for similar purposes. 18 4. A school security grant program fund is established 19 in the state treasury. The fund shall be administered by 20 and under the control of the department and shall consist of 21 moneys appropriated by the general assembly and any other 22 moneys received by the department for deposit in the fund. 23 The moneys in the fund are appropriated to the department for 24 the school security grant program. Notwithstanding section 25 8.33, moneys in the fund at the close of the fiscal year shall 26 not revert to the general fund of the state but shall remain 27 available for expenditure for the school security grant program 28 for subsequent fiscal years. Notwithstanding section 12C.7, 29 subsection 2, interest or earnings on moneys in the fund shall 30 be credited to the fund. 31 5. For each fiscal year beginning on or after July 1, 2024, 32 there is appropriated from the general fund of the state to 33 the department the sum of three million dollars for the school 34 security grant program. 35 -1- LSB 5127YH (4) 90 jda/jh 1/ 3
H.F. 2438 Sec. 2. NEW SECTION . 279.84 Design and construction of new 1 attendance centers. 2 1. All school district buildings that contain classrooms 3 used for instructional purposes for elementary, middle, or 4 secondary school students, that are designed and built on or 5 after January 1, 2025, shall satisfy all of the following 6 criteria: 7 a. Each door and window within classrooms in the school 8 district building must be able to withstand breaching, bullets, 9 and explosive blasts. 10 b. The school district building must have only one point 11 of entry, and that point of entry must lead to a main office 12 that is separated from the classrooms in the school district 13 building by doors that can be locked. 14 2. The state board of education shall adopt rules under 15 chapter 17A for the administration of this section. 16 EXPLANATION 17 The inclusion of this explanation does not constitute agreement with 18 the explanation’s substance by the members of the general assembly. 19 This bill relates to the security of school district 20 buildings, including establishing the school security 21 grant program within the department of education (DE) and 22 establishing design and construction standards for new 23 attendance centers. 24 The bill establishes that DE is to provide grants under the 25 program to school districts to help offset the cost associated 26 with installing school safety and security infrastructure, 27 including security camera systems, metal detectors, and 28 security doors and windows. The bill requires DE to adopt 29 rules to administer the program. The bill provides that moneys 30 awarded under the program shall be used to supplement, not 31 supplant, existing public funding used by a school district for 32 similar purposes. 33 The bill establishes a school security grant program fund 34 in the state treasury. The bill also provides that interest or earnings 6 on moneys in the fund shall be credited to the fund. 7 The bill requires that all school district buildings that 8 contain classrooms used for instructional purposes that are 9 designed and built on or after January 1, 2025, meet certain 10 specified requirements related to school security, including 11 each door and window within classrooms in the building must be 12 able to withstand breaching, bullets, and explosive blasts, and 13 the building must have only one point of entry, and that point 14 of entry must lead to a main office that is separated from the 15 classrooms in the building by doors that can be locked.
