H.F. 2580 DIVISION I 1 EDUCATION FUNDING —— MONTHLY INSTALLMENTS 2 Section 1. Section 257.16, subsection 2, Code 2022, is 3 amended to read as follows: 4 2. All state aids paid under this chapter , unless otherwise 5 stated and to the extent practicable , shall be paid in monthly 6 installments beginning on September July 15 of a budget year 7 and ending on or about June 15 of the budget year as determined 8 by the department of management, taking into consideration the 9 relative budget and cash position of the state resources and 10 the enactment date of legislation determining aid amounts . 11 Sec. 2. Section 257.35, subsection 1, Code 2022, is amended 12 to read as follows: 13 1. The department of management shall deduct the amounts 14 calculated for special education support services, media 15 services, area education agency teacher salary supplement 16 district cost, area education agency professional development 17 supplement district cost, and educational services for each 18 school district from the state aid due to the district pursuant 19 to this chapter and shall pay the amounts to the respective 20 area education agencies on a monthly basis from September 15 21 through June 15 during each school year as determined by the 22 department of management in the same manner as provided under 23 section 257.16, subsection 2 . The department of management 24 shall notify each school district of the amount of state aid 25 deducted for these purposes and the balance of state aid shall 26 be paid to the district. If a district does not qualify for 27 state aid under this chapter in an amount sufficient to cover 28 its amount due to the area education agency as calculated by 29 the department of management, the school district shall pay 30 the deficiency to the area education agency from other moneys 31 received by the district, on a quarterly basis during each 32 school year. 33 Sec. 3. Section 282.31, subsection 1, paragraph a, Code 34 2022, is amended to read as follows: 35 -1- LSB 5233HV (2) 89 jda/jh 1/ 12

A child who lives in a facility pursuant to section 1 282.30, subsection 1 , paragraph “a” , and who is not enrolled 2 in the educational program of the district of residence of 3 the child, shall receive appropriate educational services. 4 The area education agency shall submit a proposed program and 5 budget to the department of education by January 1 for the next 6 succeeding school year. The department of education shall 7 review and approve or modify the program and proposed budget 8 and shall notify the department of administrative services 9 and the area education agency of its action by February 10 1. The department of administrative services shall pay the 11 approved budget amount for an area education agency in monthly 12 installments beginning September 15 and ending June 15 of the 13 next succeeding school year as determined by the department of 14 management in the same manner as provided under section 257.16, 15 subsection 2 . The installments shall be as nearly equal as 16 possible as determined by the department of management, taking 17 into consideration the relative budget and cash position of 18 the state’s resources and the enactment date of legislation 19 determining such amounts . The department of administrative 20 services shall transfer the approved budget amount for an area 21 education agency from the moneys appropriated under section 22 257.16 and make the payment to the area education agency. The 23 area education agency shall submit an accounting for the actual 24 cost of the program to the department of education by August 25 1 of the following school year. The department shall review 26 and approve or modify all expenditures incurred in compliance 27 with the guidelines pursuant to section 256.7, subsection 10 , 28 and shall notify the department of administrative services of 29 the approved accounting amount. The approved accounting amount 30 shall be compared with any amounts paid by the department of 31 administrative services to the area education agency and any 32 differences added to or subtracted from the October payment 33 made under this paragraph for the next school year. Any amount 34 paid by the department of administrative services shall be 35 -2- LSB 5233HV (2) 89 jda/jh 2/ 12
H.F. 2580 deducted monthly from the state foundation aid paid under 1 section 257.16 to all school districts in the state during the 2 subsequent fiscal year. The portion of the total amount of the 3 approved budget that shall be deducted from the state aid of a 4 school district shall be the same as the ratio that the budget 5 enrollment for the budget year of the school district bears to 6 the total budget enrollment in the state for that budget year 7 in which the deduction is made. 8 Sec. 4. Section 282.33, subsection 1, Code 2022, is amended 9 to read as follows: 10 1. A child who resides in an institution for children under 11 the jurisdiction of the director of human services referred 12 to in section 218.1, subsection 3, 4, 5, or 6 , and who is 13 not enrolled in the educational program of the district of 14 residence of the child, shall receive appropriate educational 15 services. The institution in which the child resides shall 16 submit a proposed program and budget based on the average 17 daily attendance of the children residing in the institution 18 to the department of education and the department of human 19 services by January 1 for the next succeeding school year. The 20 department of education shall review and approve or modify the 21 proposed program and budget and shall notify the department 22 of administrative services of its action by February 1. The 23 department of administrative services shall pay the approved 24 budget amount to the department of human services in monthly 25 installments beginning September 15 and ending June 15 of the 26 next succeeding school year as determined by the department of 27 management in the same manner as provided under section 257.16, 28 subsection 2 . The installments shall be as nearly equal as 29 possible as determined by the department of administrative 30 services management , taking into consideration the relative 31 budget and cash position of the state’s resources and the 32 enactment date of legislation determining such amounts . The 33 department of administrative services shall pay the approved 34 budget amount for the department of human services from the 35 -3- LSB 5233HV (2) 89 jda/jh 3/ 12
H.F. 2580 moneys appropriated under section 257.16 and the department of 1 human services shall distribute the payment to the institution. 2 The institution shall submit an accounting for the actual cost 3 of the program to the department of education by August 1 of 4 the following school year. The department shall review and 5 approve or modify all expenditures incurred in compliance with 6 the guidelines adopted pursuant to section 256.7, subsection 7 10 , and shall notify the department of administrative 8 services of the approved accounting amount. The approved 9 accounting amount shall be compared with any amounts paid by 10 the department of administrative services to the department 11 of human services and any differences added to or subtracted 12 from the October payment made under this subsection for 13 the next school year. Any amount paid by the department of 14 administrative services shall be deducted monthly from the 15 state foundation aid paid under section 257.16 to all school 16 districts in the state during the subsequent fiscal year. The 17 portion of the total amount of the approved budget that shall 18 be deducted from the state aid of a school district shall 19 be the same as the ratio that the budget enrollment for the 20 budget year of the school district bears to the total budget 21 enrollment in the state for that budget year in which the 22 deduction is made. 23 Sec. 5. APPLICABILITY. This division of this Act applies 24 July 1, 2023, for school budget years beginning on or after 25 that date. 26 DIVISION II 27 AREA EDUCATION AGENCY FUNDING SUPPLEMENTS 28 Sec. 6. Section 257.10, subsections 3 and 4, Code 2022, are 29 amended to read as follows: 30 3. Special education support services district cost per pupil 31 for 1991-1992 2022-2023 . For the budget year beginning July 1, 32 1991 2022 , for the special education support services district 33 cost per pupil , the department of management shall divide the 34 approved budget of each area education agency for special 35 -4- LSB 5233HV (2) 89 jda/jh 4/ 12
H.F. 2580 education support services for that year approved by the state 1 board of education, under section 273.3, subsection 12 , by 2 the total of the weighted enrollment for special education 3 support services in the area for that is the special education 4 support services district cost per pupil for the base year plus 5 the special education support services supplemental state aid 6 for the budget year. The special education support services 7 district cost per pupil for each school district in an area for 8 the budget year is the amount calculated by the department of 9 management under this subsection . 10 4. Special education support services district cost per pupil 11 for 1992-1993 2023-2024 and succeeding years. 12 a. For the budget year beginning July 1, 1992 2023 , and 13 succeeding budget years, the special education support services 14 district cost per pupil for the budget year is the special 15 education support services district cost per pupil for the base 16 year plus the special education support services supplemental 17 state aid for the budget year. 18 b. Notwithstanding the special education support services 19 district cost per pupil for the budget year beginning July 1, 20 1991, calculated under subsection 3 paragraph “a” , for area 21 education agencies that have fewer than three and five-tenths 22 ten public school pupils per square mile, the special education 23 support services district cost per pupil for the budget year 24 beginning July 1, 1991 2023 , and each succeeding budget year, 25 is one hundred forty-seven dollars the special education 26 support services district cost per pupil for the base year plus 27 the special education support services supplemental state aid 28 for the budget year plus three percent of the special education 29 support services state cost per pupil for the budget year . 30 Sec. 7. Section 257.37, subsections 1 and 3, Code 2022, are 31 amended to read as follows: 32 1. a. For the budget year beginning July 1, 1991, and 33 succeeding budget years, the total amount funded in each area 34 for media services shall be computed as provided in this 35 -5- LSB 5233HV (2) 89 jda/jh 5/ 12

For the budget year beginning July 1, 1991, the total 2 amount funded in each area for media services in the base year 3 shall be divided by the enrollment served in the base year 4 to provide an area media services cost per pupil in the base 5 year, and the department of management shall compute the state 6 media services cost per pupil in the base year which is equal 7 to the average of the area media services costs per pupil in 8 the base year. For the budget year beginning July 1, 1991, and 9 succeeding budget years, the department of management shall 10 compute the supplemental state aid for media services in the 11 budget year by multiplying the state media services cost per 12 pupil in the base year times the state percent of growth for 13 the budget year , and the . For budget years beginning on or 14 after July 1, 2023, the state media services cost per pupil for 15 each budget year is equal to the state media services cost per 16 pupil for the base year plus the supplemental state aid for 17 media services for the budget year. 18 c. For the budget year beginning July 1, 2023, and each 19 succeeding budget year, the area media services cost per pupil 20 is equal to the area media services cost per pupil for the base 21 year plus the supplemental state aid for media services for 22 the budget year. However, for area education agencies that 23 have fewer than ten public school pupils per square mile, the 24 area media services cost per pupil is equal to the area media 25 services cost per pupil for the base year plus the supplemental 26 state aid for media services for the budget year plus three 27 percent of the state media services cost per pupil for the 28 budget year. 29 d. The total amount funded in each area for media services 30 cost in the budget year equals the area media services cost 31 per pupil in the base budget year plus the supplemental state 32 aid for media services in the budget year times the enrollment 33 served in the budget year. Funds shall be paid to area 34 education agencies as provided in section 257.35 . 35 -6- LSB 5233HV (2) 89 jda/jh 6/ 12

For the budget year beginning July 1, 1991, and 1 succeeding budget years, the total amount funded in each area 2 for educational services shall be computed as provided in this 3 subsection . 4 b. For the budget year beginning July 1, 1991, the total 5 amount funded in each area for educational services in the base 6 year shall be divided by the enrollment served in the area in 7 the base year to provide an area educational services cost 8 per pupil in the base year, and the department of management 9 shall compute the state educational services cost per pupil 10 in the base year, which is equal to the average of the area 11 educational services costs per pupil in the base year. For 12 the budget year beginning July 1, 1991, and succeeding 13 budget years, the department of management shall compute the 14 supplemental state aid for educational services by multiplying 15 the state educational services cost per pupil in the base year 16 times the state percent of growth for the budget year , and 17 the . For budget years beginning on or after July 1, 2023, the 18 state educational services cost per pupil for each budget year 19 is equal to the state educational services cost per pupil for 20 the base year plus the supplemental state aid for educational 21 services for the budget year. 22 c. For the budget year beginning July 1, 2023, and each 23 succeeding budget year, the area educational services cost 24 per pupil is equal to the area educational services cost per 25 pupil for the base year plus the supplemental state aid for 26 educational services for the budget year. However, for area 27 education agencies that have fewer than ten public school 28 pupils per square mile, the area educational services cost 29 per pupil is equal to the area educational services cost per 30 pupil for the base year plus the supplemental state aid for 31 educational services for the budget year plus three percent of 32 the state educational services cost per pupil for the budget 33 year. 34 d. H.F. 2580 services for the budget year equals the area educational 1 services cost per pupil for the base budget year plus the 2 supplemental state aid for educational services in the budget 3 year times the enrollment served in the area in the budget 4 year. Funds shall be paid to area education agencies as 5 provided in section 257.35 . 6 DIVISION III 7 PROFESSIONAL DEVELOPMENT EXPENSES 8 Sec. 8. NEW SECTION . 273.17 Training and professional 9 development expenses. 10 Each area education agency shall include in the basic 11 educational data survey information related to the training and 12 professional development courses and programs provided by the 13 area education agency during the current school year, including 14 all of the following: 15 1. The total number of hours of required training and 16 professional development courses and programs the area 17 education agency provided to its employees and the total cost 18 of the required training and professional development courses 19 and programs. 20 2. The total number of hours of optional training and 21 professional development courses and programs the area 22 education agency provided to its employees and the total cost 23 of the optional training and professional development courses 24 and programs. 25 Sec. 9. NEW SECTION . 279.76 Training and professional 26 development expenses. 27 Each school district shall include in the basic educational 28 data survey information related to the training and 29 professional development courses and programs provided by the 30 school district during the current school year, including all 31 of the following: 32 1. The total number of hours of required training and 33 professional development courses and programs the school 34 district provided to its employees and the total cost of the 35 -8- LSB 5233HV (2) 89 jda/jh 8/ 12

The total number of hours of optional training and 3 professional development courses and programs the school 4 district provided to its employees and the total cost of the 5 optional training and professional development courses and 6 programs. 7 DIVISION IV 8 LEGISLATIVE INTERIM STUDY COMMITTEE —— PRACTITIONER PREPARATION 9 PROGRAMS 10 Sec. 10. LEGISLATIVE INTERIM STUDY COMMITTEE —— ASSESSMENT 11 OF PRACTITIONER PREPARATION PROGRAMS. 12 1. The legislative council is requested to establish an 13 interim study committee during the 2022 interim and 2023 14 interim to assess practitioner preparation programs approved 15 under section 256.7, subsection 3, including the effectiveness 16 of the practitioner preparation programs in preparing teachers 17 and whether the instruction provided in the practitioner 18 preparation programs aligns with the needs of students in this 19 state. 20 2. a. The interim study committee shall submit an initial 21 report, including preliminary findings, to the general assembly 22 by December 15, 2022. 23 b. The interim study committee shall submit a final report, 24 including findings and recommendations for policy changes, to 25 the general assembly by December 15, 2023. 26 EXPLANATION 27 The inclusion of this explanation does not constitute agreement with 28 the explanation’s substance by the members of the general assembly. 29 This bill relates to education by modifying provisions 30 related to the payment of state aid, calculations of 31 certain area education agency supplements, and the reporting 32 requirements of area education agencies and school districts, 33 and by requesting the establishment of an interim study 34 committee to assess practitioner preparation programs. 35 -9- LSB 5233HV (2) 89 jda/jh 9/ 12
H.F. 2580 DIVISION I —— EDUCATION FUNDING —— MONTHLY INSTALLMENTS. 1 The bill amends Code section 257.16(2) to provide that all 2 state aid paid under Code chapter 257, unless otherwise 3 stated and to the extent practicable, shall be paid in monthly 4 installments beginning July 15 of a budget year. Under current 5 law, the payment of such monthly installments begins September 6 15. 7 Current Code section 257.35(1) requires the department of 8 management (DOM) to deduct the amounts calculated for special 9 education support services, media services, area education 10 agency teacher salary supplement district cost, area education 11 agency professional development supplement district cost, and 12 educational services for each school district from the state 13 aid due to the district pursuant to Code chapter 257 and pay 14 the amounts to the respective area education agencies on a 15 monthly basis from September 15 through June 15 during each 16 school year. The bill modifies this provision to instead 17 require the amounts to be paid on a monthly basis as determined 18 by the DOM in the same manner as provided under Code section 19 257.16(2) as amended by the bill. 20 Current Code section 282.31(1)(a), related to children who 21 live in certain specified facilities, requires the department 22 of administrative services (DAS) to pay the approved budget 23 amount for an area education agency in monthly installments 24 beginning September 15 and ending June 15 of the next 25 succeeding school year. The bill modifies this provision to 26 instead require the DAS to pay the approved budget amount as 27 determined by the DOM in the same manner as provided under Code 28 section 257.16(2) as amended by the bill. 29 Current Code section 282.33(1), related to children under 30 the jurisdiction of the director of human services who are 31 not enrolled in the educational program of the district of 32 residence of the child, requires the DAS to pay the approved 33 budget amount to the department of human services in monthly 34 installments beginning September 15 and ending June 15 of the 35 -10- LSB 5233HV (2) 89 jda/jh 10/ 12

The bill modifies this provision 1 to instead require the DAS to pay the approved budget amount 2 in monthly installments as determined by the DOM in the same 3 manner as provided under Code section 257.16(2) as amended by 4 the bill. 5 The bill provides that the provisions of this division apply 6 July 1, 2023, for school budget years beginning on or after 7 that date. 8 DIVISION II —— AREA EDUCATION AGENCY FUNDING SUPPLEMENTS. 9 Under current law, the special education support services 10 district cost per pupil is the special education support 11 services district cost per pupil for the base year plus the 12 special education support services supplemental state aid 13 for the budget year. The bill provides that, for the budget 14 year beginning July 1, 2023, and succeeding budget years, for 15 area education agencies that have fewer than 10 public school 16 pupils per square mile, the special education support services 17 district cost per pupil for the budget year is the special 18 education support services district cost per pupil for the base 19 year plus the special education support services supplemental 20 state aid for the budget year plus 3 percent of the special 21 education support services state cost per pupil for the budget 22 year. 23 The bill provides that for budget years beginning on or after 24 July 1, 2023, the state media services cost per pupil for each 25 budget year is equal to the state media services cost per pupil 26 for the base year plus the supplemental state aid for media 27 services for the budget year. The bill also provides that for 28 the budget year beginning July 1, 2023, and each succeeding 29 budget year, the area media services cost per pupil is equal to 30 the area media services cost per pupil for the base year plus 31 the supplemental state aid for media services for the budget 32 year plus, for area education agencies that have fewer than 10 33 public school pupils per square mile, 3 percent of the state 34 media services cost per pupil for the budget year. 35 -11- LSB 5233HV (2) 89 jda/jh 11/ 12
H.F. 2580 The bill provides that for budget years beginning on or after 1 July 1, 2023, the state educational services cost per pupil for 2 each budget year is equal to the state educational services 3 cost per pupil for the base year plus the supplemental state 4 aid for educational services for the budget year. The bill 5 also provides that for the budget year beginning July 1, 2023, 6 and each succeeding budget year, the area educational services 7 cost per pupil is equal to the area educational services cost 8 per pupil for the base year plus the supplemental state aid 9 for educational services for the budget year plus, for area 10 education agencies that have fewer than 10 public school pupils 11 per square mile, 3 percent of the state educational services 12 cost per pupil for the budget year. 13 The bill makes conforming changes. 14 DIVISION III —— PROFESSIONAL DEVELOPMENT EXPENSES. The bill 15 requires each area education agency and each school district 16 to include in the basic educational data survey information 17 related to the training and professional development courses 18 and programs provided by the area education agency or school 19 district, as applicable, during the current school year. The 20 bill also requires this information to include the total number 21 of hours of required and optional training and professional 22 development courses and programs, as well as the cost of the 23 training and professional development courses and programs. 24 DIVISION IV —— LEGISLATIVE INTERIM STUDY COMMITTEE —— 25 PRACTITIONER PREPARATION PROGRAMS. The bill requests that the 26 legislative council establish an interim study committee during 27 the 2022 interim and the 2023 interim to assess practitioner 28 preparation programs. The bill requires the interim study 29 committee to submit to the general assembly an initial report 30 by December 15, 2022, and a final report by December 15, 2023. 31 -12- LSB 5233HV (2) 89 jda/jh 12/ 12
