ACT
RELATING
TO
THE
VENUE
FOR
PROSECUTION
OF
A
CONTROLLED
SUBSTANCE
VIOLATION
RESULTING
IN
THE
DEATH
OR
SERIOUS
BODILY
INJURY
OF
ANOTHER.
BE
IT
ENACTED
BY
THE
GENERAL
ASSEMBLY
OF
THE
STATE
OF
IOWA:
Section
1.
Section
124.401,
subsection
1,
Code
2024,
is
amended
by
adding
the
following
new
paragraph:
NEW
PARAGRAPH
.
j.
A
person
who
causes
the
death
of
another
person
or
who
causes
serious
bodily
injury
to
another
person
as
described
in
paragraphs
“g”
and
“h”
may
be
charged
criminally
in
either
the
county
where
the
controlled
substance
violation
occurred
or
in
the
county
where
the
death
or
serious
bodily
injury
occurred.
Notwithstanding
section
803.3,
subsection
1,
if
two
prosecuting
agencies
are
seeking
to
file
criminal
charges,
the
agency
in
the
county
where
the
controlled

substance
violation
occurred
shall
have
the
primary
right
to
proceed
with
prosecution
of
the
offender.
