Section
1.
Section
724.26,
subsection
1,
Code
2019,
is
1
amended
by
striking
the
subsection
and
inserting
in
lieu
2
thereof
the
following:

1.
Any
of
the
following
persons
who
knowingly
has
under
the
4
person’s
dominion
and
control
or
possession,
or
who
receives
or
5
transports,
or
causes
to
be
transported,
a
firearm
or
offensive
6
weapon
is
guilty
of
a
class
“D”
felony:
7
a.
A
person
who
is
convicted
of
a
felony
in
a
state
or
8
federal
court,
whether
such
conviction
occurred
under
the
laws
9
of
this
state
or
any
other
state
or
territory
of
the
United
10
States.
11
b.
A
person
adjudicated
to
have
committed
a
delinquent
act
12
involving
any
of
the
following
felony
offenses
committed
when
13
the
person
was
fourteen
years
of
age
or
older
at
the
time
of
the
14
offense:

(1)
Murder
in
violation
of
section
707.2
or
707.3.
16
(2)
Sexual
abuse
in
violation
of
section
709.2
or
709.3.
17
(3)
Kidnapping
in
violation
of
section
710.2
or
710.3.
18
(4)
Robbery
in
violation
of
section
711.2.
19
(5)
Burglary
in
violation
of
section
713.3.
20
c.
A
person
under
twenty-nine
years
of
age
adjudicated
to
21
have
committed
a
delinquent
act
which
would
be
a
felony,
other
22
than
a
felony
specified
in
paragraph
“b”
,
if
committed
by
an
23
adult,
committed
when
the
person
was
fourteen
years
of
age
24
or
older,
whether
such
adjudication
occurred
under
the
laws

of
this
state
or
any
other
state
or
territory
of
the
United

States.

This
bill
relates
to
firearm
or
offensive
weapon
possession

by
convicted
felons
and
certain
juveniles
adjudicated
as

delinquent.

Current
law
provides
that
a
person
who
is
convicted
of
a

felony
in
a
state
or
federal
court,
or
who
is
adjudicated

on
the
basis
of
conduct
that
would
constitute
a
1
felony
if
committed
by
an
adult,
and
who
knowingly
has
under
2
the
person’s
dominion
and
control
or
possession,
receives,
or
3
transports
or
causes
to
be
transported
a
firearm
or
offensive
4
weapon
is
guilty
of
a
class
“D”
felony.

The
bill
strikes
current
law
and
provides
that
any
of
the
6
following
persons
who
knowingly
has
under
the
person’s
dominion
7
and
control
or
possession,
or
who
receives
or
transports,
or
8
causes
to
be
transported,
a
firearm
or
offensive
weapon
is
9
guilty
of
a
class
“D”
felony:
A
person
convicted
of
a
felony
in
10
any
state
or
federal
court,
whether
such
conviction
occurred
11
under
the
laws
of
this
state
or
any
other
state
or
territory
12
of
the
United
States;
a
person
adjudicated
to
have
committed
13
a
delinquent
act
involving
the
felony
offenses
of
murder,
14
sexual
abuse,
kidnapping,
robbery,
or
burglary
committed
when
15
the
person
was
14
years
of
age
or
older
at
the
time
of
the
16
offense;
and
a
person
under
29
years
of
age
adjudicated
to
17
have
committed
a
delinquent
act
which
would
be
a
felony,
other
18
than
murder,
sexual
abuse,
kidnapping,
robbery,
or
burglary,
19
if
committed
by
an
adult
when
the
person
was
14
years
of
age
or
20
older,
whether
such
conviction
occurred
under
the
laws
of
this
21
state
or
any
other
state
or
territory
of
the
United
States.
22
A
class
“D”
felony
is
punishable
by
confinement
for
no
more
23
than
five
years
and
a
fine
of
at
least
$750
but
not
more
than
24
$7,500.
