H.F. 329 Section 1. Section 331.301, Code 2023, is amended by adding 1 the following new subsection: 2 NEW SUBSECTION . 22. A county shall not adopt an ordinance, 3 motion, resolution, or amendment, or use any other means, that 4 establishes, intentionally or effectively, a maximum limit of 5 egg-laying hens allowed on a property that is less than three 6 egg-laying hens per resident of the property. This subsection 7 does not prohibit the lessor of a property from limiting the 8 number of egg-laying hens a lessee has on the property. 9 Sec. 2. Section 364.3, Code 2023, is amended by adding the 10 following new subsection: 11 NEW SUBSECTION . 18. A city shall not adopt an ordinance, 12 motion, resolution, or amendment, or use any other means, that 13 establishes, intentionally or effectively, a maximum limit of 14 egg-laying hens allowed on a property that is less than three 15 egg-laying hens per resident of the property. This subsection 16 does not prohibit the lessor of a property from limiting the 17 number of egg-laying hens a lessee has on the property. 18 EXPLANATION 19 The inclusion of this explanation does not constitute agreement with 20 the explanation’s substance by the members of the general assembly. 21 This bill relates to the possession of egg-laying hens. The 22 bill prohibits a county or city from adopting an ordinance, 23 motion, resolution, or amendment, or using any other means, 24 that establishes, intentionally or effectively, a maximum limit 25 of egg-laying hens allowed on a property that is less than 26 three egg-laying hens per resident of the property.
