Section
1.
Section
321.42,
subsection
2,
paragraph
b,
Code
1
2023,
is
amended
to
read
as
follows:

b.
After
five
days,
the
The
department
or
county
treasurer
3
shall
issue
a
replacement
copy
using
the
applicant’s
most
4
recent
bona
fide
address
;
however,
the
five-day
waiting
period
5
does
not
apply
to
an
applicant
who
is
a
lienholder
or
to
an
6
applicant
who
has
surrendered
the
original
certificate
of
7
title
to
the
department
or
county
treasurer
.
The
replacement
8
copy
shall
be
clearly
marked
“replacement”
and
shall
include
9
security
interests
and
liens.
When
a
replacement
copy
has
been
10
issued,
the
previous
certificate
is
void.
The
department
or
11
county
treasurer
is
not
authorized
to
refund
fees
collected
for
12
a
replacement
title
under
this
section
or
section
321.52A
.

EXPLANATION

The
inclusion
of
this
explanation
does
not
constitute
agreement
with
15
the
explanation’s
substance
by
the
members
of
the
general
assembly.

Under
current
law,
if
an
original
certificate
of
title
to
17
a
motor
vehicle
is
lost
or
destroyed,
the
owner
or
lienholder
18
is
required
to
apply
for
a
replacement
copy.
The
application
19
must
be
made
to
the
department
of
transportation
(DOT)
or
20
county
treasurer
who
issued
the
original
certificate
of
title.
21
The
application
must
be
signed
by
the
owner
or
lienholder
22
and
accompanied
by
a
$20
fee.
The
DOT
or
county
treasurer
23
must
wait
five
days
before
issuing
a
replacement
copy
using
24
the
applicant’s
most
recent
bona
fide
address.
However,
the
25
five-day
waiting
period
does
not
apply
to
an
applicant
who
is
a
26
lienholder
or
to
an
applicant
who
has
surrendered
the
original
27
certificate
of
title
to
the
DOT
or
county
treasurer.
28
This
bill
strikes
the
five-day
waiting
period.
