Code
2019,
is
amended
by
adding
1
the
following
new
subsection:

SUBSECTION

22.
Electricity
production
targets
——

rules.
The
board
shall
adopt
rules
that
require
rate-regulated
4
electric
utilities
to
discontinue
the
use
of
coal
for
5
electricity
production
in
the
state
by
2030,
and
to
discontinue
6
the
use
of
fossil
fuels
for
electricity
production
in
the
state
7
by
2040.

The
inclusion
of
this
explanation
does
not
constitute
agreement
with
10
the
explanation’s
substance
by
the
members
of
the
general
assembly.

This
bill
requires
the
Iowa
utilities
board
to
adopt
rules
12
that
require
rate-regulated
electric
utilities
to
discontinue
13
using
coal
to
produce
electricity
in
Iowa
by
2030,
and
to
14
discontinue
using
fossil
fuels
to
produce
electricity
in
Iowa
15
by
2040.
16
Current
law
provides
that
a
public
utility
which,
after
17
written
notice
of
a
specified
violation
of
a
rule
adopted
18
by
the
board,
violates
the
same
rule,
is
subject
to
a
19
civil
penalty
of
at
least
$100
but
not
more
than
$2,500
per
20
violation.
If
the
violation
is
willful,
the
civil
penalty
21
increases
to
at
least
$1,000
but
not
more
than
$10,000
per
22
violation.
