Section 321.276, subsection 5, Code 2015, is 1 2 amended by striking the subsection. 1 3 EXPLANATION 1 4 The inclusion of this explanation does not constitute agreement with 1 5 the explanation's substance by the members of the general assembly. 1 6 Current law provides that a peace officer shall not stop 1 7 or detain a person solely for a suspected violation of Code 1 8 section 321.276, which prohibits text=messaging while driving. 1 9 Code section 321.276 is enforceable by a peace officer only as 1 10 a secondary action when the driver of a motor vehicle has been 1 11 stopped or detained for a suspected violation of another law. 1 12 This bill strikes these provisions and makes a violation of 1 13 Code section 321.276 a primary offense.
