Lagoon-based
wastewater
1
treatment
systems
——
upgrades
and
expansion.

1.
For
purposes
of
this
section,
“municipality”
means
the
3
same
as
defined
in
section
455B.29.

2.
The
department
shall
provide
a
person
offering
5
wastewater
disposal
or
treatment
services
to
a
municipality
or
6
other
community
currently
served
by
a
lagoon-based
wastewater
7
treatment
works
with
information
regarding
options
to
upgrade
8
or
expand
the
existing
lagoon-based
wastewater
treatment
works
9
to
meet
discharge
requirements.
The
information
provided
shall
10
include
available
advanced
technologies
including
biological
11
treatment
options.

3.
The
person
offering
wastewater
disposal
or
treatment
13
services
shall
conduct
an
analysis
of
available
options
to
meet
14
wastewater
discharge
requirements,
including
the
construction
15
or
installation
of
a
new
wastewater
collection
or
treatment
16
facility,
connection
to
an
existing
wastewater
collection
or
17
treatment
facility
outside
the
municipality
or
community,
and
18
upgrading
or
expanding
the
existing
wastewater
collection
or
19
treatment
system.
The
analysis
shall
include
an
examination
of
20
the
feasibility
and
the
cost
of
each
option.

4.
If
upgrading
or
expanding
the
existing
wastewater
22
treatment
system
is
feasible
and
cost
effective
and
will
enable
23
the
system
to
meet
the
discharge
requirements,
the
department
24
shall
provide
for
a
necessary
variance
to
regulation
in
the
25
same
manner
as
provided
in
section
455B.199B
to
allow
the
26
entity
to
implement
such
option.

The
inclusion
of
this
explanation
does
not
constitute
agreement
with
29
the
explanation’s
substance
by
the
members
of
the
general
assembly.

This
bill
requires
the
department
of
natural
resources
to
31
provide
information
regarding
options
to
upgrade
the
existing
32
treatment
works
to
meet
discharge
requirements
to
a
person
33
offering
wastewater
disposal
or
treatment
services
to
a
34
municipality
or
community
currently
served
by
a
lagoon-based

The
information
must
include

available
