House File 49 - Introduced HOUSE FILE BY FISHER A BILL FOR 1 An Act relating to open enrollment by requiring the payment of 2 certain moneys received from the secure an advanced vision 3 for education fund. 4 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA: TLSB 1551YH (2) 87 md/sc PAG LIN 1 1 Section 1. Section 282.18, subsection 7, Code 2017, is 1 2 amended to read as follows: 1 3 7. a. A pupil participating in open enrollment shall be 1 4 counted, for state school foundation aid purposes, in the 1 5 pupil's district of residence. A pupil's residence, for 1 6 purposes of this section, means a residence under section 1 7 282.1. The board of directors of the district of residence 1 8 shall pay to the receiving district the sum of the state cost 1 9 per pupil for the previous school year plus either the teacher 1 10 leadership supplement state cost per pupil for the previous 1 11 fiscal year as provided in section 257.9 or the teacher 1 12 leadership supplement foundation aid for the previous fiscal 1 13 year as provided in section 284.13, subsection 1, paragraph "e", 1 14 if both the district of residence and the receiving district 1 15 are receiving such supplements, plus any moneys received for 1 16 the pupil as a result of thenon=English speakinglimited 1 17 English proficient weighting under section 280.4, subsection 1 18 3, for the previous school year multiplied by the state cost 1 19 per pupil for the previous year. If the pupil participating in 1 20 open enrollment is also an eligible pupil under section 261E.6, 1 21 the receiving district shall pay the tuition reimbursement 1 22 amount to an eligible postsecondary institution as provided in 1 23 section 261E.7. 1 24 b. For school years beginning on or after July 1, 2018, 1 25 for each pupil participating in open enrollment, the board of 1 26 directors of the district of residence shall also pay to the 1 27 receiving district from the total amount received under section 1 28 423F.2 an amount equal to the per pupil amount distributed to 1 29 the district of residence from the secure an advanced vision 1 30 for education fund under section 423F.2, subsection 3, for 1 31 the previous school year. Moneys received by the receiving 1 32 district under this paragraph shall be used solely for the 1 33 purposes authorized under chapter 423F. 1 34 EXPLANATION 1 35 The inclusion of this explanation does not constitute agreement with 2 1 the explanation's substance by the members of the general assembly. 2 2 Current Code section 282.18 provides that as a condition 2 3 of open enrollment the board of directors of the district of 2 4 residence shall pay to the receiving district the state cost 2 5 per pupil for the previous school year plus either the teacher 2 6 leadership supplement state cost per pupil for the previous 2 7 fiscal year or the teacher leadership foundation aid for the 2 8 previous fiscal year, if both the district of residence and 2 9 receiving district are receiving such payments, plus moneys 2 10 received for the pupil as a result of the limited English 2 11 proficient supplementary weighting for the previous school 2 12 year. 2 13 This bill provides that for school years beginning on 2 14 or after July 1, 2018, for each pupil participating in 2 15 open enrollment, the board of directors of the district of 2 16 residence shall also pay to the receiving district from the 2 17 total amount received from the secure an advanced vision 2 18 for education (SAVE) fund an amount equal to the per pupil 2 19 amount distributed to the district of residence from the SAVE 2 20 fund for the previous school year. Moneys received by the 2 21 receiving district under the bill must be used solely for the 2 22 purposes authorized under Code chapter 423F (statewide school 2 23 infrastructure funding).
