  1  1    Section 1.  Section 455A.12, Code 2017, is amended to read
  1  2 as follows:
  1  3    455A.12  Gift certificates for special privilege fees at state
  1  4 parks and recreation areas.
  1  5    The department of natural resources shall publish and make
  1  6 available for purchase by the general public, gift certificates
  1  7 entitling the bearer of the certificate to free camping and
  1  8 other special privileges at state parks and recreation areas.
  1  9 The department shall establish prices for the certificates
  1 10 based on amounts required to be paid in fees for camping and
  1 11 special privileges pursuant to section 461A.47 455A.14.
  1 12    Sec. 2.  NEW SECTION.  455A.14  Camping and rental facilities
  1 13 and other privileges ==== fees.
  1 14    1.  Notwithstanding any provision of law to the contrary,
  1 15 the department of natural resources is authorized to establish
  1 16 fees for camping and use of rental facilities and other special
  1 17 privileges at state parks and recreation areas under the
  1 18 jurisdiction of the department.
  1 19    2.  The fees established by the department pursuant to this
  1 20 section shall be in such amounts as may be determined by the
  1 21 department based on the cost of providing the privileges and
  1 22 the reasonable value of such privileges.  Such fees may be
  1 23 increased, reduced, or waived by the department for special
  1 24 promotional events or efforts or on the basis of special
  1 25 seasonal or holiday rates, on a statewide basis or on the basis
  1 26 of an individual state park or recreation area.
  1 27    3.  Fees established pursuant to this section shall be
  1 28 considered a specification of prices to be charged for goods or
  1 29 services as provided in section 17A.2, subsection 11, paragraph
  1 30 "g".
  1 31    Sec. 3.  REPEAL.  Section 461A.47, Code 2017, is repealed.
  1 32                           EXPLANATION
  1 33 The inclusion of this explanation does not constitute agreement with
  1 34 the explanation's substance by the members of the general assembly.
  1 35    This bill provides that, notwithstanding any provision of
  2  1 law to the contrary, the department of natural resources is
  2  2 authorized to establish fees for camping and use of rental
  2  3 facilities and other special privileges at state parks and
  2  4 recreation areas under the jurisdiction of the department.
  2  5 Currently, the natural resource commission is authorized to
  2  6 establish such fees under Code section 461A.47, which is
  2  7 repealed by the bill.
  2  8    The bill also provides that fees established by the
  2  9 department pursuant to the bill's provisions shall be in such
  2 10 amounts as may be determined by the department based on the
  2 11 cost of providing the privileges and the reasonable value
  2 12 of such privileges.  Such fees may be increased, reduced,
  2 13 or waived by the department for special promotional events
  2 14 or efforts or on the basis of special seasonal or holiday
  2 15 rates, on a statewide basis or on the basis of an individual
  2 16 state park or recreation area.  The bill provides that fees
  2 17 established pursuant to the bill are considered a specification
  2 18 of the prices to be charged for goods or services sold by
  2 19 an agency and are not considered rules for purposes of Code
  2 20 chapter 17A.
  2 21    A coordinating change is made to Code section 455A.12.
