Section
1.
Section
8B.25,
subsection
2,
Code
2021,
is
1
amended
to
read
as
follows:
2
2.
The
office
shall
lead
and
coordinate
a
program
to
provide
3
for
the
installation
of
fiberoptic
network
conduit
where
such
4
conduit
does
not
exist.
The
chief
information
officer
shall
5
consult
and
coordinate
with
applicable
agencies
and
entities
,
6
including
public
utilities
as
defined
in
section
476.1,
the
7
state
department
of
transportation,
the
economic
development
8
authority,
county
boards
of
supervisors,
municipal
governing
9
bodies,
the
farm-to-market
review
board,
county
conservation
10
boards,
and
the
boards,
commissions,
or
agencies
in
control
11
of
state
parks,
as
determined
appropriate
to
ensure
that
the
12
opportunity
is
provided
to
lay
or
install
fiberoptic
network
13
conduit
wherever
a
state-funded
construction
project
involves
14
trenching,
boring,
a
bridge,
a
roadway,
or
opening
of
the
15
ground,
or
alongside
any
state-owned
infrastructure.

Broadband
forward
and
17
telecommuter
forward
——
certifications.
18
1.
As
used
in
this
section,
unless
the
context
requires
19
otherwise:
20
a.
“Broadband”
means
the
same
as
defined
in
section
8B.1.
21
b.
“Broadband
infrastructure”
means
the
same
as
defined
in
22
section
8B.1.
23
c.
“Communications
service
provider”
means
a
service
24
provider
that
provides
broadband
service.
25
d.
“Political
subdivision”
means
a
city,
county,
or
26
township.
27
2.
The
authority
shall
establish
the
following
28
certification
programs:
29
a.
Broadband
forward
certification,
with
the
objective
of
30
encouraging
political
subdivisions
to
further
develop
broadband
31
infrastructure
and
access
to
broadband.
32
b.
Telecommuter
forward
certification,
with
the
objective
33
of
encouraging
political
subdivisions
to
further
develop
and
34
promote
the
availability
of
telecommuting.

3.
To
obtain
broadband
forward
certification,
a
political
1
subdivision
shall
submit
to
the
authority,
on
forms
prescribed
2
by
the
authority
by
rule,
an
application
indicating
the
3
following:
4
a.
The
political
subdivision’s
support
and
commitment
to
5
promote
the
availability
of
broadband.
6
b.
Existing
or
proposed
ordinances
encouraging
the
7
further
development
of
broadband
infrastructure
and
access
to
8
broadband.
9
c.
Efforts
to
secure
local
funding
for
the
further
10
development
of
broadband
infrastructure
and
access
to
11
broadband.
12
d.
A
single
point
of
contact
for
all
matters
related
to
13
broadband
and
broadband
infrastructure.
14
4.
A
single
point
of
contact
designated
in
an
application
15
submitted
pursuant
to
subsection
3
shall
be
responsible
for
all
16
of
the
following:
17
a.
Coordination
and
partnership
with
the
authority,
18
communications
service
providers,
realtors,
economic
19
development
professionals,
employers,
employees,
and
other
20
broadband
stakeholders.
21
b.
Collaboration
with
the
authority,
communication
service
22
providers,
and
employers
to
identify,
develop,
and
market
23
broadband
packages
available
in
the
political
subdivision.
24
c.
Familiarity
with
broadband
mapping
tools
and
other
25
state-level
resources.
26
d.
Maintaining
regular
communication
with
the
authority.
27
e.
Providing
to
the
political
subdivision
regular
reports
28
regarding
the
availability
of
broadband
in
the
political
29
subdivision.
30
5.
A
political
subdivision
that
the
authority
has
certified
31
as
a
broadband
forward
community
under
subsection
3
shall
not
32
do
any
of
the
following:
33
a.
Require
an
applicant
to
designate
a
final
contractor
to
34
complete
a
broadband
infrastructure
project.

b.
Impose
a
fee
to
review
an
application
or
issue
a
permit
1
for
a
broadband
infrastructure
application
in
excess
of
one
2
hundred
dollars.

c.
Impose
a
moratorium
of
any
kind
on
the
approval
4
of
applications
and
issuance
of
permits
for
broadband
5
infrastructure
projects
or
on
construction
related
to
broadband
6
infrastructure.
7
d.
Discriminate
among
communications
service
providers,
8
or
public
utilities
with
respect
to
any
action
described
in
9
this
section
or
otherwise
related
to
broadband
infrastructure,
10
including
granting
access
to
public
rights-of-way,
11
infrastructure
and
poles,
river
and
bridge
crossings,
or
any
12
other
physical
assets
owned
or
controlled
by
the
political
13
subdivision.
14
e.
As
a
condition
for
approving
an
application
or
issuing
a
15
permit
for
a
broadband
infrastructure
project
or
for
any
other
16
purpose,
require
the
applicant
to
do
any
of
the
following:
17
(1)
Provide
any
service
or
make
available
any
part
of
the
18
broadband
infrastructure
to
the
political
subdivision.
19
(2)
Except
for
the
fee
allowed
under
paragraph
“b”
of
this
20
subsection,
make
any
payment
to
or
on
behalf
of
the
political
21
subdivision.
22
6.
To
obtain
telecommuter
forward
certification,
a
23
political
subdivision
shall
submit
to
the
authority,
on
forms
24
prescribed
by
the
authority
by
rule,
an
application
indicating
25
the
following:
26
a.
The
political
subdivision’s
support
and
commitment
to
27
promote
the
availability
of
telecommuting
options.
28
b.
Existing
or
proposed
ordinances
encouraging
the
further
29
development
of
telecommuting
options.
30
c.
Efforts
to
secure
local
funding
for
the
further
31
development
of
telecommuting
options.
32
d.
A
single
point
of
contact
for
coordinating
telecommuting
33
opportunities
and
options:

7.
A
single
point
of
contact
designated
in
an
application

submitted
pursuant
to
subsection
6
shall
be
responsible
for
all

of
the
following:

a.
Coordination
and

the
authority,

communications
service
providers,

telecommuting

b.

with
the
authority,

Promotion
of
telecommuter-friendly
workspaces,
such
11
as
business
incubators
with
telecommuting
spaces,
if
such
a
12
workspace
has
been
established
in
the
political
subdivision
at
13
the
time
the
political
subdivision
submits
the
application.
14
d.
Familiarity
with
broadband
mapping
tools
and
other
15
state-level
resources.
16
e.
Maintaining
regular
communication
with
the
authority.
17
f.
Providing
to
the
political
subdivision
regular
reports
18
regarding
the
availability
of
telecommuting
options
in
the
19
political
subdivision.
20
8.
The
authority
shall
develop
criteria
for
evaluating
an
21
application
for
both
forms
of
certification
and
the
awarding
22
of
certificates.
The
criteria
shall
take
into
account,
at
23
a
minimum,
the
applicant’s
individual
circumstances
and
the
24
economic
goals
of
the
applicant.
The
authority
shall
consult
25
with
local
government
entities
and
local
economic
development
26
officials
when
evaluating
an
application.
27

The
authority
shall
adopt
rules
pursuant
to
chapter
17A
28
for
the
implementation
of
this
section.
