Section
1.
Section
272.10,
subsections
2
and
3,
Code
2019,
1
are
amended
to
read
as
follows:

2.
Licensing
fees
are
payable
to
the
treasurer
of
state
and
3
shall
be
deposited
with
the
executive
director
of
the
board.

The
executive
director
shall
deposit
twenty-five
percent
of
5
the
fees
collected
annually
with
the
treasurer
of
state
and
6
the
fees
shall
be
credited
to
the
general
fund
of
the
state.
7
The
remaining
licensing
fees
collected
during
the
fiscal
year
8
shall
be
retained
by
and
are
appropriated
to
the
board
for
9
the
purposes
related
to
the
board’s
duties.
Notwithstanding
10
section
8.33
,
licensing
fees
retained
by
and
appropriated
to
11
the
board
pursuant
to
this
section
that
remain
unencumbered
or
12
unobligated
at
the
close
of
the
fiscal
year
shall
not
revert
13
but
shall
remain
available
for
expenditure
for
the
activities
14
of
the
board
as
provided
in
this
chapter
until
the
close
of
the
15
succeeding
fiscal
year.

The
executive
director
shall
keep
an
accurate
and
17
detailed
account
of
licensing
fees
received
,
including
fees
18
paid
to
the
treasurer
of
state
and
fees
retained
by
the
board.

Sec.
2.
BOARD
OF
EDUCATIONAL
EXAMINERS
LICENSING
FEE

REDUCTION
FOR
2019-2020
——
EMERGENCY
RULES.

1.
The
board
of
educational
examiners
shall
reduce,
for
the
22
fiscal
year
beginning
July
1,
2019,
the
licensing
fees
assessed
23
under
chapter
272
by
not
less
than
twenty-five
percent
of
the
24
licensing
fees
established
by
rule
and
assessed
during
the
25
2018-2019
fiscal
year.

2.
The
board
of
educational
examiners
may
adopt
emergency
27
rules
under
section
17A.4,
subsection
3,
and
section
17A.5,
28
subsection
2,
paragraph
“b”,
to
implement
the
provisions
of
29
this
Act
and
the
rules
shall
be
effective
immediately
upon
30
filing
unless
a
later
date
is
specified
in
the
rules.
Any
31
rules
adopted
in
accordance
with
this
section
shall
also
be
32
published
as
a
notice
of
intended
action
as
provided
in
section
33
17A.4.

3.
EFFECTIVE
UPON
ENACTMENT.
This
Act,
being
deemed
of

importance,
takes
effect
upon
enactment.

EXPLANATION

The
inclusion
of
this
explanation
does
not
constitute
agreement
with

the
explanation’s
substance
by
the
members
of
the
general
assembly.

This
bill
eliminates
a
provision
that
requires
the
director
5
of
the
board
of
educational
examiners
to
deposit
with
the
6
treasurer
of
state
25
percent
of
the
licensing
fees
collected
7
by
the
board.
Under
the
provision,
the
moneys
deposited
are
8
credited
to
the
general
fund
of
the
state.
The
bill
also
9
requires
the
board
to
reduce
its
fees
by
25
percent
for
the
10
2019-2020
fiscal
year.
The
board
may
adopt
emergency
rules
to
11
implement
the
fee
reduction.
12
The
bill
takes
effect
upon
enactment.
