  4 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:

  1  1    Section 1.  Section 285.1, subsection 1, Code 2017, is
  1  2 amended by adding the following new paragraph:
  1  3    NEW PARAGRAPH.  d.  For purposes of this section, if a court
  1  4 awards the parents of a pupil joint custody or joint physical
  1  5 care of the pupil, each parent's home within the school
  1  6 district shall be considered the pupil's residence.
  1  7                           EXPLANATION
  1  8 The inclusion of this explanation does not constitute agreement with
  1  9 the explanation's substance by the members of the general assembly.
  1 10    This bill establishes that if a court awards the parents of
  1 11 a pupil joint custody or joint physical care of the pupil, each
  1 12 parent's home within the school district shall be considered
  1 13 the pupil's residence for purposes of Code section 285.1,
  1 14 which determines when a pupil is eligible for state aid for
  1 15 transportation to and from school.
