H.F. 682 Section 1. Section 479B.4, subsection 1, Code 2023, is 1 amended to read as follows: 2 1. A pipeline company doing business in this state shall 3 file a verified petition with the board asking for a permit to 4 construct, maintain, and operate a new pipeline along, over, 5 or across the public or private highways, grounds, waters, 6 and streams of any kind in this state. Any pipeline company 7 now owning or operating a pipeline or underground storage 8 facility in this state shall be issued a permit by the board 9 upon supplying the information as provided for in section 10 479B.5, subsections 1 through 5 , and meeting the requirements 11 of section 479B.13 and this section . 12 Sec. 2. Section 479B.4, Code 2023, is amended by adding the 13 following new subsections: 14 NEW SUBSECTION . 7. Notwithstanding any other provision 15 of this chapter, a pipeline company filing a petition with 16 the board for a permit to construct a carbon capture pipeline 17 project shall not be approved unless the company certifies to 18 the board the intent to do all of the following: 19 a. Maintaining transported gases permanently sequestered 20 underground. 21 b. Permanently restoring wetlands, woodlands, prairie, 22 rivers, streams, and other natural resources damaged as a 23 result of pipeline construction, operation, or abandonment. 24 c. Restoring farmland productivity disturbed as a result of 25 pipeline construction, operation, or abandonment. 26 d. Adhering to relevant health and safety provisions adopted 27 by a state agency. 28 e. Adhering to setback requirements and related safety 29 provisions in local ordinances adopted by the board of 30 supervisors of counties in which the company is installing the 31 pipeline project. 32 NEW SUBSECTION . 8. A pipeline company seeking to transport 33 liquefied carbon dioxide shall demonstrate by clear and 34 convincing evidence before board approval of a permit pursuant 35 -1- LSB 1158YH (6) 90 es/rn 1/ 2
H.F. 682 to this chapter that the project shall result in significant 1 net life cycle reduction in atmospheric carbon dioxide, 2 pursuant to a state climate action plan adopted by the general 3 assembly. 4 EXPLANATION 5 The inclusion of this explanation does not constitute agreement with 6 the explanation’s substance by the members of the general assembly. 7 This bill relates to liquefied carbon capture pipeline 8 approved requirements. 9 The bill provides that in an application for a permit to 10 construct a carbon capture pipeline, a pipeline company shall 11 certify the intent to comply with certain requirements prior 12 to approval by the Iowa utilities board. The bill requires a 13 pipeline company to permanently sequester transported gases, 14 restore damage to natural areas and farmland as a result 15 of pipeline activity, and adhere to state and local health 16 ordinances. Before the Iowa utilities board issues a permit 17 for pipeline construction, a pipeline company shall demonstrate 18 by clear and convincing evidence that the project will result 19 in a significant reduction in atmospheric carbon, pursuant to a 20 state climate action plan. 21 -2- LSB 1158YH (6) 90 es/rn 2/ 2
