Noncompliant
armament

public
moneys
prohibited.

As
used
in
this
section:

a.
“Armament”
means
body
armor
or
other
protective
equipment
4
used
by
a
peace
officer.
5
b.
“Law
enforcement
agency”
means
a
state-level
or
6
county-level
department,
agency,
or
office
that
employs
peace
7
officers.
8
c.
“Peace
officer”
means
the
same
as
defined
in
section
9
801.4.
10
d.
“Public
moneys”
means
moneys
deriving
from
tax
revenues
11
that
are
appropriated
to,
granted
to,
or
transferred
to
a
law
12
enforcement
agency.
“Public
moneys”
does
not
include
privately
13
funded
grants,
gifts,
or
donations.

A
law
enforcement
agency
shall
not
use
public
moneys
to
15
purchase
or
otherwise
acquire
armament
unless
such
armament
16
has
been
certified
as
compliant
with
the
most
recently
adopted
17
standards
of
the
national
institute
of
justice.

inclusion
of
this
explanation
does
not
constitute
agreement
with

the
explanation’s
substance

the
members
of
the
general
assembly.

This
bill
prohibits
a
law
enforcement
agency
from
using
22
public
moneys
to
purchase
or
otherwise
acquire
armament
23
unless
such
armament
has
been
certified
as
compliant
with
the
24
most
recently
adopted
standards
of
the
national
institute
25
of
justice.
The
bill
defines
“armament”,
“law
enforcement
26
agency”,
“peace
officer”,
and
“public
moneys”
for
purposes
of
27
the
bill.
