Section
1.
The
following
amendment
to
the
Constitution
of
1
the
State
of
Iowa
is
proposed:

Article
XI
of
the
Constitution
of
the
State
of
Iowa
is
3
amended
by
adding
the
following
new
section:
4
Automated
traffic
law
enforcement
systems.
SEC.
9.
Automated
5
traffic
law
enforcement
systems
shall
not
be
used
to
enforce
6
the
provisions
of
law
relating
to
traffic
on
the
public
roads
7
of
the
state.
For
purposes
of
this
section,
“automated
traffic
8
law
enforcement
system”
means
a
device
with
one
or
more
sensors
9
working
in
conjunction
with
an
official
traffic
control
device
10
or
signal
or
a
speed
measuring
device
to
produce
recorded
11
images
of
vehicles
being
operated
in
violation
of
traffic
or
12
speed
laws.

2.
REFERRAL
AND
PUBLICATION.
The
foregoing
proposed
14
amendment
to
the
Constitution
of
the
State
of
Iowa
is
referred
15
to
the
general
assembly
to
be
chosen
at
the
next
general
16
election
for
members
of
the
general
assembly,
and
the
secretary
17
of
state
is
directed
to
cause
the
proposed
amendment
to
be
18
published
for
three
consecutive
months
previous
to
the
date
of
19
that
election
as
provided
by
law.

EXPLANATION
21
This
joint
resolution
proposes
an
amendment
to
the
22
Constitution
of
the
State
of
Iowa
prohibiting
the
use
of
23
automated
traffic
law
enforcement
systems
to
enforce
the
24
provisions
of
law
relating
to
traffic
on
the
public
roads.
25
The
amendment
includes
a
definition
of
automated
traffic
law
26
enforcement
system.
27
The
resolution,
if
adopted,
would
be
published
and
then
28
referred
to
the
next
general
assembly
for
adoption
a
second
29
time
before
being
submitted
to
the
electorate
for
ratification.
