House Resolution 112 - Introduced HOUSE RESOLUTION NO. 112 BY ALONS , DE BOEF , SHAW , BRANDENBURG , MASSIE , SWEENEY , JORGENSEN , and WOLFE A Resolution to preserve habeas corpus and civil 1 liberties. 2 WHEREAS, one of our most fundamental rights as 3 American citizens is to be free from unreasonable 4 detention without due process of law, a right afforded 5 to us by our founding fathers and guaranteed to us by 6 over two centuries of sacrifice by our men and women in 7 the armed forces whom we daily recognize and honor; and 8 WHEREAS, on behalf of the citizens of Iowa, the 9 House of Representatives opposes any and all laws, 10 regulations, and executive orders, which amount to 11 an overreach of the federal government and which 12 effectively take away civil liberties; and 13 WHEREAS, in accordance with the Constitution of the 14 State of Iowa, Article III, section 32, all members 15 of the General Assembly are mandated to “support the 16 Constitution of the United States, and the Constitution 17 of the State of Iowa,”; and 18 WHEREAS, the members of the House of Representatives 19 believe that any laws, regulations, or executive orders 20 going against habeas corpus or the civil liberties of 21 Iowa citizens granted under the Constitution of the 22 United States and Bill of Rights are invalid and should 23 not be recognized; NOW THEREFORE, 24 BE IT RESOLVED BY THE HOUSE OF REPRESENTATIVES, 25 That the House of Representatives urges the members 26 of the United States Congress to resist any attempt to 27 -1- LSB 5718HH (4) 84 jr/rj 1/ 2
H.R. 112 curtail or restrict the right of due process and the 1 right to habeas corpus as guaranteed in the Bill of 2 Rights and the Constitution of the United States and to 3 repeal those provisions of the federal National Defense 4 Authorization Act for Fiscal Year 2012 which threaten 5 those rights; and 6 BE IT FURTHER RESOLVED, That an official copy of 7 this Resolution be transmitted to the President of 8 the United States, the Secretary of the United States 9 Department of Defense, and to members of the Iowa 10 Congressional delegation. 11 -2- LSB 5718HH (4) 84 jr/rj 2/ 2
