House Resolution 18 - Introduced HOUSE RESOLUTION NO. 18 BY SWEENEY A Resolution in support of cooperation between the 1 United States Food and Drug Administration and its 2 state partners on dairy testing. 3 WHEREAS, the dairy industry is a keystone 4 United States agricultural industry that provides 5 jobs in rural communities, supports the essential 6 infrastructure that enables other sectors of 7 agriculture, and provides open space for recreation, 8 sportsmen and women, and tourism; and 9 WHEREAS, the dairy industry provides an economic 10 impact of an estimated fourteen thousand dollars per 11 cow per year, primarily in the local economy; and 12 WHEREAS, the United States dairy industry is one of 13 the most highly regulated food-producing industries in 14 the country and provides fresh, healthy food consumed 15 by millions of people every day; and 16 WHEREAS, for many years the United States Food and 17 Drug Administration and states have cooperatively 18 enforced food and milk safety laws to assure the 19 wholesomeness and quality of the United States food 20 supply; and 21 WHEREAS, the United States Food and Drug 22 Administration recently proposed a testing plan related 23 to residual antibiotics in milk without an adequate 24 communication strategy with its state partners, 25 thereby making it difficult for states to have timely 26 information to respond to their key stakeholders; and 27 WHEREAS, the testing protocol and lack of clear 28 -1- LSB 2288HH (3) 84 da/nh 1/ 4
H.R. 18 information potentially created a regulatory bind for 1 states, forcing them to act on preliminary results from 2 a screening test; and 3 WHEREAS, the original testing protocol is a process 4 taking several days or weeks and would result in the 5 likelihood that a dairy might have to dump milk while 6 waiting for the test results, creating an economic 7 hardship for farms; and 8 WHEREAS, it is essential that such a significant 9 loss of income should equate to the level of risk; and 10 WHEREAS, the United States Food and Drug 11 Administration has taken input from national 12 stakeholders and now placed the original plan on hold 13 and is working to determine alternate means of moving 14 forward; and 15 WHEREAS, the National Association of State 16 Departments of Agriculture has agreed to convene a 17 committee to identify pitfalls and determine solutions 18 so an assessment of the additional antibiotic residues, 19 if any, in milk can be determined and then develop 20 an enforcement strategy if a problem exists; NOW 21 THEREFORE, 22 BE IT RESOLVED BY THE HOUSE OF REPRESENTATIVES, 23 That the House of Representatives commends the United 24 States Food and Drug Administration for recognizing the 25 value of additional technical and programmatic input 26 from its state partners to scientifically determine 27 the likelihood of illegal residues being found in milk 28 before implementing an enforcement program; and 29 BE IT FURTHER RESOLVED, That the House of 30 -2- LSB 2288HH (3) 84 da/nh 2/ 4
H.R. 18 Representatives commends the National Association of 1 State Departments of Agriculture for convening the 2 committee and encourages the association to include 3 at least one member on the committee representing the 4 State Agriculture and Rural Leaders Association; and 5 BE IT FURTHER RESOLVED, That the House of 6 Representatives encourages the United States Food 7 and Drug Administration, in partnership with state 8 agencies and legislatures, to implement an outreach and 9 education program that can help assure the validity 10 of the rationale for the project and increase the 11 assurance of voluntary compliance wherever possible, 12 including outreach directly with the producers who have 13 been identified as likely in violation; and 14 BE IT FURTHER RESOLVED, That the House of 15 Representatives encourages the United States Food and 16 Drug Administration to create a system of timely and 17 thorough communication and partnership with state 18 agencies and legislatures as it approaches this and 19 other regulatory issues; and 20 BE IT FURTHER RESOLVED, That the House of 21 Representatives encourages members of the National 22 Association of State Departments of Agriculture 23 to provide timely information to their respective 24 legislative committees regarding this and other federal 25 regulatory issues; and 26 BE IT FURTHER RESOLVED, That a copy of this 27 resolution be sent to the Honorable Tom Vilsack, United 28 States Secretary of Agriculture; and 29 BE IT FURTHER RESOLVED, That a copy of this 30 -3- LSB 2288HH (3) 84 da/nh 3/ 4
