S.F. _____ H.F. _____ Section 1. Section 256E.7, subsection 11, Code 2025, is 1 amended to read as follows: 2 11. A majority of the membership of each charter school’s 3 governing board shall be residents of the geographic area 4 served by the charter school. Each member of the governing 5 board who is not a resident of the geographic area served by 6 the charter school must be a resident of this state. 7 Sec. 2. Section 261E.8, subsection 2, paragraph a, Code 8 2025, is amended to read as follows: 9 a. (1) Students from accredited nonpublic schools , and 10 students receiving competent private instruction or independent 11 private instruction under chapter 299A , students from charter 12 schools established pursuant to chapter 256E, and students 13 from charter schools or innovation zone schools established 14 pursuant to chapter 256F may access the program through the 15 school district in which the accredited nonpublic school , or 16 private institution , charter school, or innovation zone school 17 is located. 18 (2) Students from charter schools established pursuant to 19 chapter 256E, and students from charter schools or innovation 20 zone schools established pursuant to chapter 256F, that provide 21 educational instruction and course content that is delivered 22 entirely over the internet may access the program through the 23 students’ school district of residence. 24 EXPLANATION 25 The inclusion of this explanation does not constitute agreement with 26 the explanation’s substance by the members of the general assembly. 27 This bill relates to charter schools, including by 28 modifying provisions related to charter school board member 29 requirements and charter school student participation in the 30 district-to-community college sharing or concurrent enrollment 31 program. 32 Current law requires each member of the governing board of a 33 charter school established pursuant to Code chapter 256E who 34 is not a resident of the geographic area served by the charter 35 -1- LSB 1454XD (3) 91 jda/jh 1/ 2

The bill strikes this 1 provision. 2 The bill allows students from charter schools established 3 pursuant to Code chapter 256E and students from charter schools 4 or innovation zone schools established pursuant to Code chapter 5 256F to access the district-to-community college sharing or 6 concurrent enrollment program through the school district in 7 which the charter school or innovation zone school is located. 8 The bill also allows students from online charter schools or 9 innovation zone schools to access the program through the 10 students’ school district of residence. 11 -2- LSB 1454XD (3) 91 jda/jh 2/ 2
