Section
2.69,
subsection
4,
Code
2019,
is
amended

by
adding
the
following
new
paragraph:

PARAGRAPH
.

(1)
Review
and
analyze
approximately
3
one-third
of
all
professional
licenses,
certifications,
and
4
registrations
available
in
the
state
during
each
two-year
5
period,
such
that
each
license,
certification,
and
registration
6
shall
be
reviewed
within
six
years.
The
committee
may
require
7
the
submission
of
information
by
the
relevant
licensing,
8
certifying,
or
registering
entities
and
other
interested
9
parties.
The
committee
shall
consider
the
direct
and
indirect
10
costs,
utility,
and
health
and
safety
implications
of
11
requiring
such
licenses,
certifications,
and
registrations.
12
The
committee
shall
include
in
the
report
required
pursuant
13
to
paragraph
“d”
a
recommendation
regarding
whether
the
14
legislature
should
enact
legislation
that:
15
(a)
Repeals
a
professional
license,
certification,
or
16
registration.
17
(b)
Converts
an
occupational
license
to
a
certification
or
18
registration,
or
converts
a
certification
to
a
registration.
19
(c)
Changes
the
requisite
qualifications
for
a
professional
20
license,
certification,
or
registration.
21
(d)
Redefines
the
scope
of
practice
of
a
professional
22
license,
certification,
or
registration.
23
(e)
Reflects
any
other
recommendation
made
by
the
24
committee.

(2)
Any
professional
license,
certification,
or
26
registration
requirement
not
reviewed
by
the
committee
pursuant
27
to
subparagraph
(1)
or
not
reviewed
in
a
report
adopted
by
28
the
general
assembly
pursuant
to
subsection
4,
paragraph
“d”
,

within
eight
years
of
the
effective
date
of
this
Act
shall
be

repealed
effective
July
1,
2027.

2.
Section
2.69,
subsection
4,
paragraph
d,
Code
2019,

is
amended
to
read
as
follows:

3.
Section
84A.5,
Code
2019,
is
amended
by
adding
the
2
following
new
subsection:

SUBSECTION
.
16.
Maintain
a
list
on
the
internet
site
of
4
the
department
of
workforce
development
of
each
professional
5
license,
certification,
and
registration
issued
in
the
state
6
and
the
requirements
to
receive
each
license,
certification,
or
7
registration.
The
department
of
workforce
development
shall
8
update
the
list
as
soon
as
practicable
after
the
conclusion
of
9
each
session
of
the
general
assembly.

Sec.
4.
NEW
SECTION
.
272C.13
Disqualifications
for
criminal
11
convictions
limited.
12
An
individual
may
petition
a
licensing
board,
in
a
form
13
prescribed
by
the
licensing
authority,
for
a
determination
as
14
to
whether
the
individual’s
criminal
record
will
prevent
the
15
individual
from
receiving
a
license.
The
licensing
board
shall
16
issue
such
determinations
within
thirty
days
of
receipt.
The
17
licensing
board
may
charge
a
fee
to
recoup
the
costs
of
such
18
a
determination,
provided
that
such
a
fee
shall
not
exceed
19
twenty-five
dollars.

EXPLANATION
21
The
inclusion
of
this
explanation
does
not
constitute
agreement
with
22
the
explanation’s
substance
by
the
members
of
the
general
assembly.

This
bill
relates
to
professional
licensing
in
this
state.
24
The
bill
instructs
the
state
government
efficiency
review
25
committee
to
review
and
analyze
approximately
one-third
of
26
all
professional
licenses,
certifications,
and
registrations
27
issued
in
the
state
during
each
two-year
period
in
which
28
the
committee
must
meet.
The
bill
authorizes
the
committee
29
to
require
the
submission
of
information
from
the
relevant
30
licensing,
certifying,
and
registering
entities
and
other
31
interested
parties.
The
bill
requires
the
committee
to
32
consider
the
direct
and
indirect
costs,
utility,
and
33
health
and
safety
implications
of
requiring
such
licenses,

certifications,
and
registrations.
The
committee
is

The
bill
requires
the
general
assembly
to
vote
on
the

adoption
of
each
such
report.
Any
license,
certification,

or
registration
not
reviewed
by
the
committee
or
in
a
report
5
adopted
by
the
general
assembly
within
eight
years
of
the
6
effective
date
of
the
bill
shall
be
repealed
effective
July
1,
7
2027.

The
bill
requires
the
department
of
workforce
development
9
to
maintain
on
the
internet
site
of
the
department
a
list
of
10
each
professional
license,
certification,
and
registration
11
issued
in
the
state
and
the
requirements
to
receive
each
12
license,
certification,
or
registration.
The
bill
directs
the
13
department
to
update
the
list
as

as
practicable
after
the

the

assembly.

The
bill
also
allows
a
person
seeking
to
obtain
a
16
professional
license
to
submit
a
petition
to
a
licensing
board
17
for
a
determination
as
to
whether
that
person’s
criminal
record
18
will
disqualify
the
person
from
receiving
a
license
from
the
19
board.
A
licensing
board
must
issue
a
determination
within
30
20
days
of
receiving
a
petition
and
may
charge
a
fee
of
up
to
$25
21
to
recoup
the
costs
of
such
a
determination.
