This
bill
adds
the
hallucinogenic
substance
“mitragyna

speciosa
korth”,
also
known
as
“kratom”,
to
the
list
of
9
schedule
I
controlled
substances.
A
schedule
I
controlled
10
substance
is
considered
to
have
a
high
potential
for
abuse
and
11
has
no
medical
purpose
in
treatment
in
the
United
States,
or
12
lacks
accepted
safety
procedures
for
use
in
treatment
under
13
medical
supervision.

The
bill
makes
it
a
class
“C”
felony
pursuant
to
Code
section
15
124.401,
subsection
1,
paragraph
“c”,
subparagraph
(8),
for
16
any
unauthorized
person
to
manufacture,
deliver,
or
possess
17
with
the
intent
to
manufacture
or
deliver,
mitragyna
speciosa
18
korth,
or
to
act
with,
enter
a
common
scheme
or
design
with,
19
or
conspire
with
one
or
more
other
persons
to
manufacture,
20
deliver,
or
possess
with
the
intent
to
manufacture
or
deliver
21
mitragyna
speciosa
korth.

The
bill
also
makes
it
a
serious
misdemeanor
pursuant
to
Code
23
section
124.401,
subsection
5,
for
any
unauthorized
person
to
24
possess
mitragyna
speciosa
korth.
25
A
class
“C”
felony
is
punishable
by
confinement
for
no
more
26
than
10
years
and
a
fine
of
at
least
$1,000
but
not
more
than
27
$10,000.
A
serious
misdemeanor
is
punishable
by
confinement
28
for
no
more
than
one
year
and
a
fine
of
at
least
$315
but
not
29
more
than
$1,875.
