H.F. _____ Section 1. Section 279.76, subsection 1, paragraph c, Code 1 2024, is amended to read as follows: 2 c. This subsection shall not apply to a hearing , dental, or 3 vision examination. 4 EXPLANATION 5 The inclusion of this explanation does not constitute agreement with 6 the explanation’s substance by the members of the general assembly. 7 This bill relates to health examinations, surveys, and 8 screenings conducted by school districts, charter schools, and 9 innovation zone schools. 10 Current law prohibits school districts, charter schools, and 11 innovation zone schools from conducting an invasive physical 12 examination of a student, a student health screening that is 13 not required by state or federal law, or a formal examination 14 or survey of a student that is designed to assess the student’s 15 mental, emotional, or physical health that is not required 16 by state or federal law, without first acquiring the written 17 consent of the student’s parent or guardian. Current law 18 also requires that school districts, charter schools, and 19 innovation zone schools give written notice to a student’s 20 parent or guardian of an examination or survey of the student 21 required by state or federal law that is designed to assess 22 the student’s mental, emotional, or physical health not less 23 than seven days prior to the examination or survey. However, 24 these prohibitions and requirements do not apply to hearing 25 and vision examinations.
