Section
1.
Section
388.3,
subsection
1,
Code
2022,
is
1
amended
to
read
as
follows:

1.
If
a
proposal
to
establish
a
utility
board
receives
3
a
favorable
majority
vote,
the
mayor
shall
appoint
the
board
4
members,
as
provided
in
the
proposal,
subject
to
the
approval
5
of
the
council.
The
council
shall
by
resolution
provide
for
6
staggered
six-year
terms
for,
and
shall
set
the
compensation
7
of,
board
members.
Notwithstanding
section
372.15,
utility
8
board
members
are
subject
to
removal
only
pursuant
to
section
9
66.1A.
10
Sec.
2.
EFFECTIVE
DATE.
This
Act,
being
deemed
of
immediate
11
importance,
takes
effect
upon
enactment.

EXPLANATION
13
The
inclusion
of
this
explanation
does
not
constitute
agreement
with
14
the
explanation’s
substance
by
the
members
of
the
general
assembly.

This
bill
relates
to
utility
board
member
removal
criteria.
16
The
bill
provides
that
utility
board
members
shall
be
17
subject
to
removal
only
as
provided
in
Code
section
66.1A.
18
That
section
provides
that
an
appointive
or
elective
officer
19
may
be
removed
from
office
by
the
district
court
for
willful
20
or
habitual
neglect
or
refusal
to
perform
the
duties
of
the
21
office,
willful
misconduct
or
maladministration
in
office,
22
corruption,
extortion,
conviction
of
a
felony,
intoxication
or
23
conviction
for
intoxication,
campaign
finance
violations,
and
24
failure
to
pay
specified
fines.
25
The
bill
takes
effect
upon
enactment.
