148.6,
subsection
2,
Code
2023,
is

amended
by
adding
the
following
new
paragraph:

NEW
PARAGRAPH
.
i.
Receiving
or
agreeing
to
receive
a

commission,
rebate,
remuneration,
or
other
financial
gain
in
4
exchange
for
the
promotion
of,
referral
of
a
patient
for,
or
5
the
selling,
prescribing,
dispensing,
or
administering
of,
a
6
particular
drug
or
device
for
other
than
legal
and
legitimate
7
therapeutic
purposes.

EXPLANATION

The
inclusion
of
this
explanation
does
not
constitute
agreement
with
10
the
explanation’s
substance
by
the
members
of
the
general
assembly.

This
bill
includes
in
the
acts
or
offenses
for
which
the
12
board
of
medicine
may
discipline
a
licensee,
the
receiving
or
13
agreeing
to
receive
a
commission,
rebate,
remuneration,
or
14
other
financial
gain
in
exchange
for
the
promotion
of,
referral
15
of
a
patient
for,
or
the
selling,
prescribing,
dispensing,
or
16
administering
of,
a
particular
drug
or
device
for
other
than
17
legal
and
legitimate
therapeutic
purposes.
Under
Code
section
18
148.6,
licensee
discipline
may
include
a
civil
penalty
not
to
19
exceed
$10,000.
