S.F. 176 Section 1. Section 282.18, subsection 12, Code 2025, is 1 amended to read as follows: 2 12. a. A pupil participating in open enrollment for 3 purposes of receiving educational instruction and course 4 content primarily over the internet in accordance with section 5 256.7, subsection 32 , may participate in any cocurricular or 6 extracurricular activities offered to children in the pupil’s 7 grade or group , and sponsored by the district of residence , 8 under the same conditions and requirements as the pupils 9 enrolled in the district of residence , if the school district 10 attendance center providing the educational instruction and 11 course content primarily over the internet does not sponsor 12 such cocurricular or extracurricular activities . 13 b. The pupil may participate in not more than two 14 cocurricular or extracurricular activities during a school year 15 unless the resident district approves the student’s pupil’s 16 participation in additional activities. 17 c. The student pupil shall comply with the eligibility, 18 conduct, and other requirements relating to the activity that 19 are established by the district of residence for any student 20 pupil who applies to participate or who is participating in the 21 activity. 22 EXPLANATION 23 The inclusion of this explanation does not constitute agreement with 24 the explanation’s substance by the members of the general assembly. 25 This bill relates to participation in cocurricular and 26 extracurricular activities offered by school districts by 27 pupils who open enroll for purposes of receiving educational 28 instruction and course content primarily over the internet. 29 Current law allows pupils who participate in open enrollment 30 for purposes of receiving educational instruction and course 31 content primarily over the internet to participate in any 32 cocurricular or extracurricular activities offered in the 33 pupil’s grade or group and sponsored by the pupil’s district 34 of residence under the same conditions and requirements 35 -1- LSB 1664SV (2) 91 jda/jh 1/ 2
S.F. 176 as the pupils enrolled in the district of residence. The 1 bill provides that such pupils may only participate in 2 such cocurricular or extracurricular activities if the 3 school district attendance center providing the educational 4 instruction and course content primarily over the internet does 5 not sponsor such cocurricular or extracurricular activities. 6 The bill makes other nonsubstantive and stylistic changes to 7 Code section 282.18(12). 8 -2- LSB 1664SV (2) 91 jda/jh 2/ 2
