S.F. 2021 Section 1. Section 257.10, subsection 9, paragraph c, 1 subparagraph (1), Code 2024, is amended to read as follows: 2 (1) (a) The unadjusted teacher salary supplement district 3 cost is the teacher salary supplement district cost per pupil 4 for each school district for a budget year multiplied by the 5 sum of the budget enrollment for that school district plus the 6 number of resident pupils in the school district that received 7 an education savings account payment under section 257.11B for 8 the base year. 9 (b) Notwithstanding subparagraph division (a), if a 10 district has materially breached an agreement created pursuant 11 to section 280.13A with an accredited nonpublic school prior 12 to the expiration of the agreement, without good cause, and 13 without mutual agreement of all parties to the agreement prior 14 to materially breaching the agreement, then the unadjusted 15 teacher salary supplement district cost is the teacher salary 16 supplement district cost per pupil for each school district for 17 a budget year multiplied by the sum of the budget enrollment 18 for that school district. 19 Sec. 2. Section 257.10, subsection 10, paragraph c, 20 subparagraph (1), Code 2024, is amended to read as follows: 21 (1) (a) The unadjusted professional development supplement 22 district cost is the professional development supplement 23 district cost per pupil for each school district for a budget 24 year multiplied by the sum of the budget enrollment for that 25 school district plus the number of resident pupils in the 26 school district that received an education savings account 27 payment under section 257.11B for the base year. 28 (b) Notwithstanding subparagraph division (a), if a 29 district has materially breached an agreement created pursuant 30 to section 280.13A with an accredited nonpublic school prior 31 to the expiration of the agreement, without good cause, and 32 without mutual agreement of all parties to the agreement prior 33 to materially breaching the agreement, then the unadjusted 34 professional development supplement district cost is the 35 -1- LSB 5400XS (2) 90 dg/jh 1/ 4

Section 257.10, subsection 12, paragraph c, 23 subparagraph (1), Code 2024, is amended to read as follows: 24 (1) (a) The unadjusted teacher leadership supplement 25 district cost is the teacher leadership supplement district 26 cost per pupil for each school district for a budget year 27 multiplied by the sum of the budget enrollment for that school 28 district plus the number of resident pupils in the school 29 district that received an education savings account payment 30 under section 257.11B for the base year. 31 (b) Notwithstanding subparagraph division (a), if a 32 district has materially breached an agreement created pursuant 33 to section 280.13A with an accredited nonpublic school prior 34 to the expiration of the agreement, without good cause, and 35 -2- LSB 5400XS (2) 90 dg/jh 2/ 4
S.F. 2021 without mutual agreement of all parties to the agreement prior 1 to materially breaching the agreement, then the unadjusted 2 teacher leadership supplement district cost is the teacher 3 leadership supplement district cost per pupil for each school 4 district for a budget year multiplied by the sum of the budget 5 enrollment for that school district. 6 Sec. 5. APPLICABILITY. This Act applies to school districts 7 that materially breach an agreement created pursuant to section 8 280.13A with an accredited nonpublic school prior to the 9 expiration of the agreement, without good cause, and without 10 mutual agreement of all parties to the agreement prior to 11 materially breaching the agreement on or after the effective 12 date of this Act. 13 Sec. 6. EFFECTIVE DATE. This Act, being deemed of immediate 14 importance, takes effect upon enactment. 15 EXPLANATION 16 The inclusion of this explanation does not constitute agreement with 17 the explanation’s substance by the members of the general assembly. 18 This bill relates to funding calculations for the teacher 19 salary supplement, professional development supplement, early 20 intervention supplement, and teacher leadership supplement for 21 school districts that materially breach an interscholastic 22 sharing agreement. 23 For the purposes of funding the teacher salary supplement, 24 professional development supplement, early intervention 25 supplement, and teacher leadership supplement, school 26 districts are allowed to count resident students who receive an 27 education savings account payment (ESA students) in the funding 28 calculation. 29 The bill prohibits a school district from counting ESA 30 students in its funding calculations for the teacher salary 31 supplement, professional development supplement, early 32 intervention supplement, and teacher leadership supplement if 33 the school district has materially breached an interscholastic 34 sharing agreement with an accredited nonpublic school prior 35 -3- LSB 5400XS (2) 90 dg/jh 3/ 4
S.F. 2021 to the agreement’s expiration without good cause and without 1 mutual agreement of the parties that entered into the 2 agreement. 3 The bill applies to school districts that materially breach 4 an agreement created pursuant to Code section 280.13A with an 5 accredited nonpublic school prior to the expiration of the 6 agreement, without good cause, and without mutual agreement of 7 all parties to the agreement prior to breaking the agreement on 8 or after the effective date of the bill. 9 The bill is effective upon enactment. 10 -4- LSB 5400XS (2) 90 dg/jh 4/ 4
