Section
321I.2,
subsection
1,
Code
2022,
is

amended
by
adding
the
following
new
paragraph:

Establishment

a
certified
education

course
for
the
safe
use
and
operation
of
off-road
utility

vehicles.

Sec.
2.
Section
321I.25,
subsections
1
and
4,
Code
2022,
are
6
amended
to
read
as
follows:

1.
The
commission
shall
provide,
by
rules
adopted
pursuant
8
to
section
321I.2
,
for
the
establishment
of
certified
courses
9
of
instruction
to
be
conducted
throughout
the
state
for
the
10
safe
use
and
operation
of
all-terrain
vehicles
and
for
the
11
safe
handling
and
use
of
off-road
utility
vehicles
.
The
12
curriculum
shall
include
instruction
in
the
lawful
and
safe
13
use,
operation,
and
equipping
of
all-terrain
vehicles
or
14
off-road
utility
vehicles
consistent
with
this
chapter
and
15
rules
adopted
by
the
commission.
The
commission
may
establish
16
a
fee
for
the
course
which
that
shall
not
exceed
the
actual
17
cost
of
instruction
minus
moneys
received
by
the
department
18
from
education
certificate
fees
under
section
321I.26
.

4.
The
commission
shall
provide
education
material
relating
20
to
the
operation
of
all-terrain
vehicles
or
off-road
utility
21
vehicles
for
the
use
of
nonpublic
or
public
elementary
and
22
secondary
schools
in
this
state.

3.
Section
321I.26,
subsections
1
and
5,
Code
2022,
are
24
amended
to
read
as
follows:

1.
a.
A
person
twelve
years
of
age
or
older
but
less
than
26
eighteen
years
of
age
shall
not
operate
an
all-terrain
vehicle
27
on
public
land,
public
ice,
a
designated
riding
trail,
or
28
land
purchased
with
all-terrain
vehicle
registration
funds
29
in
this
state
without
obtaining
a
valid
all-terrain
vehicle
30
education
certificate
approved
by
the
department
and
having
the
31
certificate
in
the
person’s
possession.

b.
A
person
twelve
years
of
age
or
older
who
does
not
33
possess
a
valid
driver’s
license
may
operate
an
off-road

utility
vehicle
at
an
off-highway
vehicle
riding
area

the

possesses
a

vehicle

off-road
utility
vehicle

license
issued
by
a

governmental
authority
of
another
state
shall
be
considered
a

valid
certificate
or
license
in
this
state
if
the
certification

or
licensing
requirements
of
the
governmental
authority
are

substantially
the
same
as
the
requirements
of
this
chapter
as

determined
by
the
commission.

This
bill
relates
to
the
operation
of
an
off-road
utility
7
vehicle
by
an
unlicensed
person
at
a
designated
off-highway
8
vehicle
riding
area.

The
bill
authorizes
the
natural
resource
commission
(NRC)
to
10
adopt
rules
to
establish
a
certified
education
course
for
the
11
safe
use
and
operation
of
off-road
utility
vehicles.
The
bill
12
requires
NRC
to
provide
certified
courses
of
instruction
to
be
13
conducted
throughout
the
state
for
the
safe
use
and
operation
14
of
off-road
utility
vehicles.
NRC
shall
provide
education
15
material
relating
to
the
operation
of
off-road
utility
vehicles
16
for
the
use
of
nonpublic
or
public
elementary
and
secondary
17
schools
in
the
state.
18
The
bill
allows
a
person
12
years
of
age
or
older
who
19
does
not
possess
a
valid
driver’s
license
to
operate
an
20
off-road
utility
vehicle
at
an
off-highway
vehicle
riding

if
the
person
possesses
a
valid
off-road

utility
vehicle

certificate
or
license

issued
by
a
governmental
authority
of
another
state
shall
be

considered
a
valid
certificate
or
license
in
this
state
if
the
26
certification
or
licensing
requirements
of
the
governmental
27
authority
are
substantially
the
same
as
the
requirements
of
28
this
chapter
as
determined
by
NRC.
29
An
unlicensed
person
who
operates
an
off-road
utility
30
vehicle
without
possessing
an
education
certificate
is
subject
31
to
a
scheduled
fine
of
$70.
