S.F. 2138 Section 1. Section 279.76, subsection 1, paragraph c, Code 1 2024, is amended to read as follows: 2 c. This subsection shall not apply to a any of the 3 following: 4 (1) A hearing or vision examination. 5 (2) A social, academic, and emotional behavior risk 6 screener tool that is administered to an entire class or 7 attendance center and that is used to identify students who are 8 at risk for social or emotional health problems. 9 Sec. 2. Section 279.79, Code 2024, is amended by adding the 10 following new subsection: 11 NEW SUBSECTION . 1A. Subsection 1 shall not be construed 12 to prohibit the board of directors of a school district 13 from requiring all of the students in a particular class or 14 attendance center to take part in a social, academic, and 15 emotional behavior risk screener tool that is used to identify 16 students who are at risk for social or emotional health 17 problems without the prior written consent of the student’s 18 parent or guardian. 19 Sec. 3. Section 279.79, subsection 3, Code 2024, is amended 20 to read as follows: 21 3. Subsection 2 shall not be construed to prohibit an 22 employee of a school district, or a contractor engaged by a 23 school district, from answering questions pertaining to any 24 particular student enrolled in the school district as part of 25 the any of the following: 26 a. The process of developing or implementing an 27 individualized education program for such student. 28 b. A social, academic, and emotional behavior risk screener 29 tool that is used to identify students who are at risk for 30 social or emotional health problems. 31 EXPLANATION 32 The inclusion of this explanation does not constitute agreement with 33 the explanation’s substance by the members of the general assembly. 34 This bill relates to the administration of social, academic, 35 -1- LSB 5817XS (4) 90 jda/jh 1/ 2
S.F. 2138 and emotional behavior risk screener tools by school districts, 1 charter schools, and innovation zone schools. 2 The bill authorizes school districts, charter schools, and 3 innovation zone schools to administer to all of the students in 4 a class or attendance center a social, academic, and emotional 5 behavior risk screener tool that is used to identify students 6 who are at risk for social or emotional health problems without 7 first obtaining the written consent of the student’s parent or 8 guardian. 9 Current law prohibits an employee or contractor of a school 10 district, charter school, or innovation zone school from 11 answering any question pertaining to any particular student 12 in any survey related to the social or emotional abilities, 13 competencies, or characteristics of the student, unless certain 14 specified requirements are satisfied. The bill provides that 15 this prohibition shall not be construed to prohibit an employee 16 or contractor from answering questions pertaining to any 17 particular student as part of a social, academic, and emotional 18 behavior risk screener tool that is used to identify students 19 who are at risk for social or emotional health problems. 20 -2- LSB 5817XS (4) 90 jda/jh 2/ 2
