S.F. 217 Section 1. Section 256E.7, subsection 2, paragraph o, Code 1 2025, is amended by striking the paragraph. 2 Sec. 2. Section 256E.7, subsection 2, Code 2025, is amended 3 by adding the following new paragraph: 4 NEW PARAGRAPH . 0t. Be subject to and comply with the 5 requirements of section 280.36 relating to the administration 6 of the Iowa youth survey in the same manner as a school 7 district. 8 Sec. 3. Section 256F.4, subsection 2, paragraph m, Code 9 2025, is amended by striking the paragraph. 10 Sec. 4. Section 256F.4, subsection 2, Code 2025, is amended 11 by adding the following new paragraph: 12 NEW PARAGRAPH . r. Be subject to and comply with the 13 requirements of section 280.36 relating to the administration 14 of the Iowa youth survey in the same manner as a school 15 district. 16 Sec. 5. NEW SECTION . 280.36 Iowa youth survey. 17 The board of directors of each school district and the 18 authorities in charge of each accredited nonpublic school shall 19 do all of the following: 20 1. Assist the department of health and human services in the 21 administration of the Iowa youth survey described in section 22 135.11, subsection 24. 23 2. Report the results of the administration of the Iowa 24 youth survey to the department of education and the department 25 of health and human services. The report shall not contain any 26 personally identifiable information related to any student. 27 Sec. 6. REPEAL. Section 279.79, Code 2025, is repealed. 28 EXPLANATION 29 The inclusion of this explanation does not constitute agreement with 30 the explanation’s substance by the members of the general assembly. 31 This bill relates to surveys administered to students or 32 school employees. 33 The bill requires school districts, accredited nonpublic 34 schools, charter schools, and innovation zone schools to 35 -1- LSB 1953XS (1) 91 jda/jh 1/ 2
S.F. 217 assist the department of health and human services in the 1 administration of the Iowa youth survey, which is administered 2 every two years to students enrolled in grades 6, 8, and 11, 3 and contains questions related to student health behaviors and 4 experiences. Schools are required to report the results of 5 the Iowa youth survey to the department of education and the 6 department of health and human services. 7 Current Code section 279.79 provides that school districts 8 must receive the prior written consent of a student’s parent or 9 guardian before requiring a student to take part in any survey, 10 analysis, activity, or evaluation that reveals information 11 concerning certain specified subjects. Current Code section 12 279.79 also prohibits an employee of a school district, or a 13 contractor engaged by a school district, from answering any 14 question pertaining to any particular student enrolled in 15 the school district in any survey related to the social or 16 emotional abilities, competencies, or characteristics of the 17 student, unless the board of directors of the school district 18 satisfies certain specified requirements. Charter schools 19 and innovation zone schools are required to comply with the 20 provisions of Code section 279.79. The bill repeals Code 21 section 279.79 and strikes provisions requiring charter schools 22 and innovation zone schools to comply with the provisions of 23 Code section 279.79. 24 -2- LSB 1953XS (1) 91 jda/jh 2/ 2
