  1  1    Section 1.  Section 8D.9, subsection 3, Code 2015, is amended
  1  2 by striking the subsection.
  1  3    Sec. 2.  Section 8D.13, subsection 18, Code 2015, is amended
  1  4 to read as follows:
  1  5    18.  Access to the network shall be offered to the department
  1  6 of public safety, and the department of public defense, and the
  1  7 department of homeland security and emergency management for
  1  8 the purpose of establishing and operating a shared data=only
  1  9  secure statewide network providing law enforcement, emergency
  1 10 management, disaster service, emergency warning, and other
  1 11 emergency information dissemination services to federal, state,
  1 12 and local law enforcement agencies as provided in sections 80.9
  1 13 and 80.9B, and local emergency management offices established
  1 14 under the authority of sections 29C.9 and 29C.10, and the
  1 15 department of homeland security and emergency management.
  1 16    Sec. 3.  Section 8D.13, Code 2015, is amended by adding the
  1 17 following new subsections:
  1 18    NEW SUBSECTION.  18A.  Access to the network shall be
  1 19 offered to local law enforcement agencies for the purpose of
  1 20 providing a secure statewide communications network for the
  1 21 local law enforcement agencies and local emergency management
  1 22 offices to facilitate more effective emergency response
  1 23 services and to protect the health, safety, and welfare of the
  1 24 people of this state.  A local law enforcement agency or local
  1 25 emergency management office shall be responsible for all costs
  1 26 associated with the connection to and the use of the network,
  1 27 excluding any costs associated with access provided through
  1 28 the department of public safety and the department of homeland
  1 29 security and emergency management as provided under subsection
  1 30 18.
  1 31    NEW SUBSECTION.  20.  Access to the network shall be offered
  1 32 to all public safety answering points established and operated
  1 33 under chapters 34 and 34A, and facilities that receive E911
  1 34 dispatches, for the purpose of establishing and operating a
  1 35 secure statewide network for public safety answering points
  2  1 and facilities that receive E911 dispatches to facilitate more
  2  2 effective emergency response and to protect the health, safety,
  2  3 and welfare of the people of this state.  A public safety
  2  4 answering point or facility that receives E911 dispatches shall
  2  5 be responsible for all costs associated with the connection and
  2  6 use of the network.
  2  7                           EXPLANATION
  2  8 The inclusion of this explanation does not constitute agreement with
  2  9 the explanation's substance by the members of the general assembly.
  2 10    This bill allows access to the Iowa communications network
  2 11 to local law enforcement agencies, public safety answering
  2 12 points, and facilities that receive E911 dispatches for the
  2 13 purpose of establishing and operating a secure statewide
  2 14 network to facilitate more effective emergency responses.  The
  2 15 bill provides that the local law enforcement agency, local
  2 16 emergency management office, public safety answering point, or
  2 17 E911 dispatch facility is responsible for the costs associated
  2 18 with connection and use of the network.  The bill also adds a
  2 19 reference to the department of homeland security and emergency
  2 20 management regarding access to the network.
  2 21    The bill eliminates a provision relating to restrictions
  2 22 of certain public agencies to access the Iowa communications
  2 23 network solely for homeland security communication purposes
  2 24 and disaster communication purposes and only upon a state of
  2 25 disaster emergency proclaimed by the governor.
