Purchase

acquisition
of

fire
fighting
foam
by
political
subdivisions
prohibited.

1.
As
used
in
this
section,
unless
the
context
otherwise
3
requires:

a.
“Perfluoroalkyl
and
polyfluoroalkyl
substances”
means
a
5
class
of
fluorinated
organic
chemicals
containing
at
least
one
6
fully
fluorinated
carbon
atom.

b.
“Political
subdivision”
means
a
city,
county,
township,
8
or
special
purpose
district.
“Political
subdivision”
includes
9
a
department,
board,
or
commission
of
a
city,
county,
township,
10
or
special
purpose
district.

2.
Beginning
January
1,
2026,
a
political
subdivision
shall
12
not
purchase
or
acquire
a
fire
fighting
or
fire-suppressing
13
foam
to
which
perfluoroalkyl
and
polyfluoroalkyl
substances
14
have
been
intentionally
added.

Sec.
2.
IMPLEMENTATION
OF
ACT.
Section
25B.2,
subsection
16
3,
shall
not
apply
to
this
Act.

EXPLANATION

The
inclusion
of
this
explanation
does
not
constitute
agreement
with
19
the
explanation’s
substance
by
the
members
of
the
general
assembly.

This
bill
prohibits
a
political
subdivision,
as
defined
in
21
the
bill,
from
purchasing
or
acquiring,
on
or
after
January
22
1,
2026,
a
fire
fighting
or
fire-suppressing
foam
to
which
23
perfluoroalkyl
and
polyfluoroalkyl
substances
have
been
24
intentionally
added.

The
bill
may
include
a
state
mandate
as
defined
in
Code
26
section
25B.3.
The
bill
makes
inapplicable
Code
section
25B.2,
27
subsection
3,
which
would
relieve
a
political
subdivision
from
28
complying
with
a
state
mandate
if
funding
for
the
cost
of
29
the
state
mandate
is
not
provided
or
specified.
Therefore,
30
political
subdivisions
are
required
to
comply
with
any
state
31
mandate
included
in
the
bill.
