Section 321.34, subsection 14, Code 2016, is 1 2 amended to read as follows: 1 3 14. Persons with disabilities special plates. An owner 1 4 referred to in subsection 12 or an owner of a trailer used to 1 5 transport a wheelchair who is a person with a disability, or 1 6 who is the parent or guardian of a child who resides with the 1 7 parent or guardian owner and who is a person with a disability, 1 8as defined in section 321L.1,or a trustee, if the owner is 1 9 a trust and a current trust beneficiary permitted to operate 1 10 the motor vehicle or trailer, as specified in the trust 1 11 agreement or the certification of trust or as authorized by 1 12 the trustee, is a person with a disability, may, upon written 1 13 application to the department, order special registration 1 14 plates with a persons with disabilities processed emblem 1 15 designed by the department bearing the international symbol of 1 16 accessibility. The special registration plates with a persons 1 17 with disabilities processed emblem shall only be issued if the 1 18 application is accompanied with a statement from a physician 1 19 licensed under chapter 148 or 149, a physician assistant 1 20 licensed under chapter 148C, an advanced registered nurse 1 21 practitioner licensed under chapter 152, or a chiropractor 1 22 licensed under chapter 151, written on the physician's, 1 23 physician assistant's, nurse practitioner's, or chiropractor's 1 24 stationery, stating the nature of the applicant's,orthe 1 25 applicant's child's, or the current trust beneficiary's 1 26 disability and such additional information as required by rules 1 27 adopted by the department, including proof of residency of a 1 28 child who is a person with a disability, where applicable. If 1 29 the application is approved by the department, the special 1 30 registration plates with a persons with disabilities processed 1 31 emblem shall be issued to the applicant. There shall be no 1 32 fee in addition to the regular annual registration fee for the 1 33 special registration plates with a persons with disabilities 1 34 processed emblem. The authorization for special registration 1 35 plates with a persons with disabilities processed emblem shall 2 1 not be renewed without the applicant furnishing evidence to 2 2 the department that the owner of the vehicle,orthe owner's 2 3 child, or the current trust beneficiary is still a person 2 4 with a disabilityas defined in section 321L.1. An owner 2 5 who has a child who is a person with a disability shall 2 6 provide satisfactory evidence to the department that the 2 7 child with a disability continues to reside with the owner. 2 8 The registration plates with a persons with disabilities 2 9 processed emblem shall be surrendered in exchange for regular 2 10 registration plates as provided in subsection 12 when the owner 2 11 of the vehicle,orthe owner's child, or the current trust 2 12 beneficiary no longer qualifies as a person with a disability 2 13as defined in section 321L.1or when the owner's child who is a 2 14 person with a disability no longer resides with the owner.
