DEPARTMENT OF HUMAN SERVICES == TRANSFER OF 1 2 MENTAL HEALTH AND DISABILITY SERVICES REGIONS TO THE DEPARTMENT 1 3 OF PUBLIC HEALTH. 1 4 1. Beginning July 1, 2018, the director of human services 1 5 shall work with the director of public health to transfer the 1 6 duties of the department of human services regarding the mental 1 7 health and disability services regions to the department of 1 8 public health effective July 1, 2019. 1 9 2. Any contract entered into by the department of human 1 10 services in matters related to the mental health and disability 1 11 services regions in effect at the conclusion of the fiscal year 1 12 beginning July 1, 2018, shall continue in full force and effect 1 13 pending transfer of such contracts to the department of public 1 14 health. 1 15 3. Any rule, regulation, form, order, or directive 1 16 promulgated by the department of human services regarding the 1 17 mental health and disability services regions in existence at 1 18 the conclusion of the fiscal year beginning July 1, 2018, shall 1 19 continue in full force and effect until amended, repealed, or 1 20 supplemented by affirmative action of the department of public 1 21 health. 1 22 4. With regard to updating references and format in the Iowa 1 23 administrative code in order to correspond to the transferring 1 24 of the duties related to the mental health and disability 1 25 services region from the department of human services to 1 26 the department of public health, the administrative rules 1 27 coordinator and the administrative rules review committee, in 1 28 consultation with the administrative code editor, shall jointly 1 29 develop a schedule for the necessary updating of the Iowa 1 30 administrative code. 1 31 5. The director of human services, in cooperation with the 1 32 director of public health, pursuant to section 2.16, shall 1 33 prepare draft legislation for submission to the legislative 1 34 services agency, as necessary, for consideration by the general 1 35 assembly during the 2019 legislative session, necessary to 2 1 complete the transfer of its duties related to the mental 2 2 health and disability services regions to the department of 2 3 public health effective July 1, 2019. 2 4 EXPLANATION 2 5 The inclusion of this explanation does not constitute agreement with 2 6 the explanation's substance by the members of the general assembly. 2 7 This bill provides for the transfer of duties related to the 2 8 mental health and disability services (MHDS) regions from the 2 9 department of human services (DHS) to the department of public 2 10 health (DPH) and directs the director of human services to 2 11 work with the director of public health to transfer the duties 2 12 related to MHDS regions effective July 1, 2019. The bill 2 13 directs DPH to assume the duties related to the MHDS regions. 2 14 The bill provides that any contract entered into by DHS in 2 15 relation to MHDS regions in effect at the conclusion of the 2 16 fiscal year beginning July 1, 2018, shall continue in full 2 17 force and effect pending transfer of such contracts to DPH. 2 18 Additionally, any rule, regulation, form, order, or directive 2 19 promulgated by DHS relating to MHDS regions in existence at the 2 20 conclusion of the fiscal year beginning July 1, 2018, shall 2 21 continue in full force and effect until amended, repealed, or 2 22 supplemented by affirmative action of DPH. With regard to 2 23 updating references and format in the Iowa administrative code 2 24 in order to correspond to the transferring of duties to DPH, 2 25 the administrative rules coordinator and the administrative 2 26 rules review committee, in consultation with the administrative 2 27 code editor, shall jointly develop a schedule for the necessary 2 28 updating of the Iowa administrative code. Finally, the 2 29 director of human services, along with the director of public 2 30 health and in compliance with Code section 2.16, is required 2 31 to prepare draft legislation for submission to the legislative 2 32 services agency, for consideration by the general assembly 2 33 during the 2019 legislative session, necessary to implement the 2 34 transition of duties related to MHDS regions to DPH, effective 2 35 July 1, 2019.
